I really don't know what to write. On the one hand, I want to be funny. But, on the other hand, I am seriously pissed about this.

Funny: Can the Griz look at going the SEC route and just assign a girl to each incoming football player?

Serious: These incidents are no longer a just "a one bad apple". Regardless if there is actual legal wrong doing by Jordon Johnson, it is quite clear that the culture of the UM football team is one of power, control, aggression, and narcissism. Frankly, I am sliding closer to the thought that the UM football team should have one or two years suspended from all play. Yeah, you read that right. This is just a game, these players are negatively affecting people for the rest of their lives. Real people.

Uh oh, charges have been filed now. Guilty or Not Guilty this has been a BAD year for UM. Someone better get a hold of the reigns and start disciplining the players AND the Coach and AD.
We have a great coach, AD and players. You could only wish MSU had an AD as good as O'Day or a Head Coach as good as Pflugrad. UM has great leadership at the top.

I don't.

Is it basically a matter of filing a complaint and then law enforcement determines whether there is enough evidence to file charges?

I am with you, it is hard to root for players when just can't trust that they are decent people. And I surely don't want my girls to grow up admiring these boys when there seem to be such a large collection of creeps in their midst.

And I need to hear outrage from the fans, not a bunch of excuses. This cannot all be the fault of the girls, or Gwen Florio, or anything else other than the football team. There is no way there is this much out there, and not some blame to be had on the part of the football team. And maybe Pflugrad didn't create, or in any way cause this problem, and likely he never even envisioned it, but if he wants to be the leader of this team he had better figure out a way to solve it.

A DA files charges when there is sufficient evidence to do so. Anyone can file a police report for any reason. The simple filing of a report doesn't necessarily mean legal charges are forthcoming.

Haha...I've never filed a complain, never had one filed against me, or really had any experience at all with the law enforcement process. But that's basically that I assumed.

If the DA does file charges, is there an arrest warrent issued at that time as well, or does there need to be further evidence for an arrest?

I sure know the difference. In order for the charge to be filed, there first must be a complaint.

Good post Sportin'. My outrage will come when the investigation to the alleged gang rape and the staff's response or lack of response to it comes out. That may be very soon according to Engstrom.
 
As to the complaint procedure: The Missoula Police Department receives the complaint. They evaluate the basic allegations. If suffcient facts can be determined in the complaint, the PD can develop enough probable cause to find the suspect and make an arrest. Or, the PD can investigate and take their findings to the Missoula County Attorney's Office for further evaluation. If the CA finds probable cause, that office will file a charging document (an Information and Affidavit) with the District Court. The court will issue an arrest warrant for the suspect.

If neither the PD or the CA find probable cause, there will be no arrest. The complaint will be placed in a file for use in later a circumstance should more investigation reveal newer facts.

I do this kind of work in a CA office.
 
lost in all this is a confusing timeline.

sometime in early febr - jj has a confrontation with the woman per mpd.
mar. 9 - t.r.o. is filed
mar. 12 - jj's attorney receives t.r.o.
mar. 15 (in the evening) - foley says he (o;day, engstrom and pflugrad) first heard of the t.r.o.
mar. 16 - woman files sexual assault claim
mar. 20 - hearing scheduled to determine if t.r.o. is made permanent

so why wait almost a month to file a t.r.o.? and why the 3 day delay between when the attorney got the t.r.o. and um finding out? odd that the atty/jj didn't inform anyone at um about this.
 
Solid questions. Wondering where you got the "early february"...everything I've seen says sometime in February. It seems that early feb vs late feb would be a big difference on the perceived validity of the complaint.
