Oh where to start.

1.) This is a temporary restraining order, the kind in Montana that anyone can fill out against anyone without proving a thing. Because nothing has been proven, TROs are almost always granted no questions asked. They are not granted by the the police department. 4.) When was the last time a Missoula TV news station reported on a TRO? Probably never would be my guess. I suspect the news station got a lot of help finding the TRO.

5.) Was there a sexual assault at all? There's no penalty filing a TRO on grounds that can't be proven. There's no penalty for filing a TRO that's totally false. If the TRO is bogus, it won't be made permanent and the issue will just go away.

6.) It is really too bad that the TV station didn't contact the person who filed the order to get a better feel for whether this TRO had merit. If it does have merit, the accuser should be building a case for making it permanent. She should have compelling proof. If she doesn't, that would be a good indicator that this ordeal is a non-starter. So far, she has provided no information backing her claim so far, despite being allowed several pages to explain in her own words why the TRO was needed in the first place, which should have sent up red flags for the news station.

I have no idea if this TRO is warranted and will have to wait like everyone else to find out.

But to be able to file a TRO and accuse someone of rape violence etc just to hurt them and damage their reputation deserves some sort of actual punishment. It seems to me the act of slandering someone with a false sexual assault TRO to get even should be a criminal act. If it can be proven that the accusation is completely untrue and was intentionally done to hurt the other person. Sexual assualt accusations do not just dissapear there are always many people who will believe the accused is guilty no matter what evidence is given to the contrary.
 
This has been one of the most fun reads from about page 3 on ... a study in how to use silliness to deflect any real meaningful reflection. It's what I love most about fan forums; we know nearly nothing about the situation but are more than willing to cast aspersions on either the player or the young woman simply by virtue of the team we fancy. Time to step back, let the facts sort out, and shut up until they do so. There will always be instances of acquaintance rape (unfortunately too common when relationships end - just google the term "intimate rape" or "marital rape" to get an idea how commonly sexual assault is used as a weapon to hurt women in relationships), just as there will be instances of false allegations of rape/sexual assault and WE just don't know what is the case here.
 
Thank you Hannah for your post but you lost me. You state that we should all shut up, (which is great advice) but then you keep talking about rape.

The point is that either version could be true ... It's not unheard of for men to use assault as a weapon or for women to make false allegations. We just don't know but it's interesting to see people jump to one conclusion or another simply because they are a fan of one team. And I just used the term "rape" for the uninitiated-it makes the goggle search more simple (the unfortunate reality is sexual assault or rape, the distinction makes little mind when you're the victim). Buzz kill that, Snap :shock:

I think Hannah makes a lot of sense. This is a matter that will eventually be aired out in the proper venue -- a court of law. Fan forums, the media, any social outlet or the like, are simply arenas for speculation and opinion, none of which matter in the long run. It's been 20 years since I've actively practiced law, but I've been involved in hundreds of these matters and know fully well that sometimes a TRO is justified and other times, it is not. And 100% of the time, it is not up to me to make any decisions or suppositions -- as such, I'll sit back and wait for this one to run its course.
 
Hannah is an educated liar. She knows very well the difference between sexual assault and rape.
How can you claim that to a women victim that there is no distinction between an act of "inappropriate touching" (sexual assault) or "vaginal rape" (rape). You are flame throwing, worse than Florio.
And I agree with her that we should shut up until the facts are known.
 
I did not realize that any penetration of ANY orifice by ANY object is considered rape in Montana(among other definitions). I did not know this until I jury member in a lengthy trial all about this crap.
