What gets me is the fact that the judge in Helena agreed to the release of these documents after they are heavily redacted to protect the privacy of those involved. You would have to be living on another planet these past years not to be able to fill in those redacted blanks once the documents are made public! How is this going to protect anyones privacy?

Yeah, it's a joke. To be fair, it's probably the correct decision based on law. But even the Missoulian story lists Johnson three times by name. I mean, what's the point of redaction now?
 
When his bloated corpse is finally found, the list of suspects will be filled in with just this thread. Not that he hasn't made a whole list of enemies by all his bullshit already.

Agreed, but I think it's pretty obvious why U of M paid JJ a $245,000 settlement. It surely won't fit Krakauer's agenda, however.
 
It looks to me like this will get appealed to the MT Sup Ct. Krakauer just wants to get more attention and press for his book and himself, I assume. What occurred back then isn't going to be very relevant, because my understanding is the UM or the university system has changed their rules and procedures in this area.

Yes.

Okay, then tell us what the law is and why it's a correct decision based on the law. I don't think it's a correct decision, and don't agree with most of what the judge has done along the way.

About the investigation or about what was involved in the later stages of UM's decision?

Many of the docs in the initial investigation by the dean were made public in a federal court case long ago. The facts of what occurred that night and thereafter are in the transcripts of an almost 3 week trial. Most people believe Krakauer has already gotten ahold of a confidential almost 30 page report done by university system counsel, i.e. the one that apparently outlined all of the mistakes by the dean and UM and which resulted in UM deciding to allow Mr. Doe to continue in school with his scholarship and then resulted in the $245,000 payment to Mr. Doe. Paoli's earlier filing indicated that he believes Krakauer obtained some of the file illegally, and now is just trying to get the court to bless that it is okay for him to have it. Why has Krakauer and his lawyer resisted saying/showing what he already has, and resisted allowing the other side to depose him?

Yes. He knows what he's getting, and he's actually getting less than he already has.

Why doesn't Krakhauer dig into why the President of the University and his cronies gave a Saudi student who had been involved in at least a couple sexual misconduct items a heads up that the University and the authorities were going to question him. Thereby tipping him off and letting him leave the country to go back home for "personal reasons?"
