...& c'mon... if they're having sex in the missionary position she's probably "pinned." If JJ wanted to have sex doggy style... usually the accepted non verbal cue is to begin rolling the woman over & she usually assists... Duerk is trying to make something out of nothing. :roll:

All it takes is for the prosecution to twist his words or make the jury believe one thing when JJ meant something else and he could be in trouble. Risky move by the defense in my opinion, but I guess that's why they get paid the big bucks.

I think hearing JJ say definitively that he believed the had consent was very important.

From what I'm seeing on twitter, Duerk is basically just repeating the accuser's testimony out loud to Jordy and highlighting the fact that their stories don't match. We already knew that. Not sure how that constitutes "shredding" JJ....it's just reinforcing the fact that this is "he said, she said".

And apparently it wasn't that important to her. She got on top and started to make out after a few minutes of the movie. And at the end she said she had to pick up her friends. Was he supposed to say, "No, I want to finish this movie!"

The prosecution is just trying to make JJ look like an ass. Which he may be (I feel like he is morel ike 99% of any college student), but it still doesn't change the fact that a rape did or did not occur. Hopefully the jury doesn't convict him because they think he was mean to her.
 
Pabst objects to miss statement of evidence by prosecution and is overruled....pretty much the trial in a nutshell.

This trial is a complete he said/she said.

I don't know much about rape but I'm guessing in most rape situations you don't really change positions and kiss during the act. They were having sex in the missionary position, while changing positions they continued to kiss. I know that is his word but the prosecution never refuted that statement.
