I'm not following on Twitter so don't know if your statement is true or not, but that's precisely why I would not have let him take the stand. All it takes is for the prosecution to twist his words or make the jury believe one thing when JJ meant something else and he could be in trouble. Risky move by the defense in my opinion, but I guess that's why they get paid the big bucks.

I think hearing JJ say definitively that he believed the had consent was very important.

Agreed. Still risky though.
 
I do not understand why people are so surprised that JJ testified. This is a he said/she said thing. If he doesn't testify, then it becomes only a she said. There was no question from the very beginning that he would testify. It is always risky putting the defendant on the stand but this one was a no-brainer.

Pardon me while I try to play legal pundit for the moment.....

One lingering question for me about this trial is the idea of not using a condom. I've heard that disucussing past sexual partners is not admissible, but I'm kind of surprised neither Jane Doe, nor JJ were asked about whether it's common for them to have unprotected sex, as I assume neither were virgins before that night. It would seem the answer to that question (assuming judge would allow) potentially could have opened a pandora's box one way or the other (maybe that's why no one asked the question?).

Do any of the legal minds have thoughts on this?

Rape shield laws keep out any reference to her sexual history, but not his. Not sure what the addition of a condom would have added to the case. If he used one, it would look more consensual, but she asked him if he had one, and when he said no, she went forth anyway.

that's a trap question for JJ. Cause if he answers I usually do....it looks like he raped her.
if he says no I don't.....he looks like a sleez ball.
jj wanted to avoid that question.
that is why they made it obvious that she asked him and he said he didn't have one. Meaning he did not intend the sex before, and she said "its OK" which leads him to believe consent.
That worked in his favor. The prosecution, maybe should have asked that question. but I guess must have had reason not to.
 
For those watching more closely, there appears to be some discussion on twitter that JJ admits to "pinning" the accuser. If that's true, that would certainly lend some credibility to the claim. Anyone have any thoughts on how effective that was for the prosecution?

From the Twitter feed it sounds as though his attorneys rehabilitated him on redirect, when they had him clarify that he had his hands on her arms, but that he didn't have his weight on his hands and she could have gotten up and or away from him if she really wanted to.

At least that's how I read it.

In my opinion, it didn't look good for JJ while the tweets were flowing about the "pinning". But when you add that he claims he didn't hear a no or would have stoped if it appeared non-consentual, you end up right back at square one with he said she said. Also, pinning her by the arms does not explain the marks on her chest that the prosecution went over with the First Step nurse.
This thing just needs to get to the jury so it can all be done one way or the other.
