JJ Trial

If I have the order of testimony right, it looks like he pinned her arms at one point, but then by both accounts they stopped, kissed, and she "assisted" him in changing position or "flipping over," coupled with the "oh you are bad!" baby talk... Hardly the picture of brutal assault Gwen and Pat would like us to envision....

From the Twitter feed it sounds as though his attorneys rehabilitated him on redirect, when they had him clarify that he had his hands on her arms, but that he didn't have his weight on his hands and she could have gotten up and or away from him if she really wanted to.

At least that's how I read it.

+1 The prosecutor on cross kept framing this as "pinning her arms" and got JJ to agree to the statement. Not sure in the end that it is going to make a tinker's damn bit of difference in the big picture. The defense seemed to cover it well and the prosecution looked manipulative in persuading JJ to say it.

One lingering question for me about this trial is the idea of not using a condom. I've heard that disucussing past sexual partners is not admissible, but I'm kind of surprised neither Jane Doe, nor JJ were asked about whether it's common for them to have unprotected sex, as I assume neither were virgins before that night. It would seem the answer to that question (assuming judge would allow) potentially could have opened a pandora's box one way or the other (maybe that's why no one asked the question?).

that's a trap question for JJ. Cause if he answers I usually do....it looks like he raped her.
if he says no I don't.....he looks like a sleez ball.
jj wanted to avoid that question.
that is why they made it obvious that she asked him and he said he didn't have one. Meaning he did not intend the sex before, and she said "its OK" which leads him to believe consent.
That worked in his favor. The prosecution, maybe should have asked that question. but I guess must have had reason not to.

Is "It's OK" in the testimony somewhere? Might not "It's OK" be interpreted as consent?

WTF is the Missoulian attempting to do with that tweet? What the hell does it even mean?

What does it mean? Well...one could infer that the man who said it has shown what he cares about in this case (Grizzly football).

I'm not going to infer that, but it certainly wasn't the smartest thing for that individual to say.

Yeah. I know a few of them but knew in advance that they were getting called. But I know her the best and had no idea she was getting called. But she is a reluctant witness so that is probably why.

I don't know anything besides what is on twitter. HA is a very smart girl that comes from a very good family.

Looks like they are both in the pharmacy program and HA has noticed the accuser has never left class crying like she has stated. Discrediting the accusers information.

Just saying she's never seen the woman leave class crying. Hasn't seen a change in the woman. They have the same group of friends.

In my opinion, it didn't look good for JJ while the tweets were flowing about the "pinning". But when you add that he claims he didn't hear a no or would have stoped if it appeared non-consentual, you end up right back at square one with he said she said. Also, pinning her by the arms does not explain the marks on her chest that the prosecution went over with the First Step nurse.
This thing just needs to get to the jury so it can all be done one way or the other.

Didn't Jane Doe, bare chested, pin Johnson down and dry hump him? How did that look to you? Duerk's fixation with a man grabbing a woman's wrists during sex made me wonder if he'd ever experienced the act. Likewise with one partner turning the other over.

How out of character would it have have been for either of the above to have occured during an an act that according to Doe included her date inserting his entire hand into her vagina, an act she never indicates she objected to?
He grabbed her wrists?
