JJ pleads not guilty to rape charges

The one thing I feel most likely to hurt JJ and he suposedly admitted it. He was under the influence of alcohol, so most of what he says happened will be highly questionable.

Without a breathalyzer--where is Royce Engstrom when you need one? :thumb: --I think the prosecution is going to have a difficult time arguing he was greatly impaired and drinking affected his judgement. If the prosecution had a valid scientific measurement of his blood alcohol that could indeed help them, but they don't.

The defense could also argue that JJ indeed was exercising clear judgement and prudence when he called his friend to come pick him up because he had consumed 3-4 beers and wanted to be cautious about drinking and driving.

Well case over. If he pleads not guilty then he isn't guilty. No wait, that is what the victim's proponents do, they believe everything she says and pronounce guilt without hearing both sides. I guess we better let this thing play out. Seems like there is a difference of opinion and we don't have all the evidence yet. :thumb:

Don't you guys think that if there were texts from either one of them discussing their lack of a future together, that JJ would have been charged?

Quite honestly, I don't think he would have. I mean, that's quite a bit of evidence that what she is doing is revenge based. Obviously her lawyer has had access to the texts that were sent and received. This leads me to believe there were no texts discussing a future relationship or something like that.
 
About how long will it take to actually get this to trial? I mean it took 6 months to press charges. One would think that most of the evidence is gathered.

???? Are you saying there were no texts between them afterward? I think you are correct but there were plenty of texts between her and her friends.
 
One wild card is that the prosecutors have listed David Aronofsky and Charles Couture on their witness list. This may mean that they have some damaging statements JJ made during the Code of Conduct case. They'll have to produce all of that stuff for the defense prior to trial.

As far as how long this will take, it is not unusual for felony cases to take a year or more to get to trial, but JJ has a constitutional right to a speedy trial and under the circumstances it would seem prudent for the defense to assert JJ's speedy trial right and push for a trial as soon as possible.

Do you really think so? It would seem at this point that the prosecution has had way more preparation time than the defense, wouldn't more time be an advantage for the defense? I'm no lawyer just asking.
 
Could there be more speculation?

It sounds like a very complicated matter. Let justice prevail.

I am told that the case against JJ is very much an uphill battle for the prosecutor.

It will take a few weeks to sort out the issue of the 1000 emails that the prosecutor is reviewing and redacting, but JJ's defense is pretty simple, isn't it? The prosecutor needs to exclude all reasonable doubt as to the issue of consent, and JJ has some pretty simple common sense arguments to make to the jury about why there is at least a reasonable doubt on that point. It shows great confidence in their case to tell the judge "We don't need a lot of time. Once we get the emails and other documents the prosecutor has, we can be ready to go in a few weeks. This young man's life is on the line and he can't wait to show the jury he's been wrongly charged."

I'm not proclaiming guilt or innocence on either party, but I do question, if JJ were innocent, why she would go to such lengths to say he raped her. Both of their lives are going to be ruined because of this. Perhaps I'm just uninformed, but I don't see her making any money off of this... did the incident happen on campus?

It will be important to ascertain when the initial PTSD diagnosis was made on the victim. It could be surprising. :o
