Found this from an article entitled: "Does a Sexual Position Indicate Consent?" This is what a judge asked in a rape case:
"What shocked the victim most was when the judge questioned whether she was really raped since he found it “odd” that was she was on top of Escobar during the assault. The judge required the victim to recount, in detail, her position during the rape and explain how Escobar, who maintained the sex was consensual, was able to force himself on her.
“I know these are tough questions and I don’t like to have to ask them,” the judge told the victim, according to a July 31 transcript, released late last week. “It’s just you understand that most rapes take place with the man on top so he has complete control of the female.”
The case involved threats and perhaps force.
"The victim testified that she repeatedly fought her attacker, but that he wasn’t fazed by the blows to his face and was able to force himself on her. All the while, she said, Escobar threatened to put her “in the bayou,” claiming to have killed five people already and saying he’d do the same to her with a knife she believed he had in his pocket."
This below quote is from the author of the article:
"It is in fact true that the position the attacker used during his rape is not the most common one used."

Well, that leaves out the part in the rest of her statement, "he" claimed he had had a couple of beers, and that was his excuse for not wanting to drive. It also leaves out the rest of the statement "When she picked him up and brought him back to her house, she did not think he had been drinking."

Questioning at the trial of the roommate disclosed only that the roommate thought JJ was "quiet, shy," and offered no testimony relating to any perception of alcohol or "drunkeness" whatsoever. And neither did Jane Doe.
Now, notice the amazing silence by those who object to opinions based on trial testimony, when an opinion negative to JJ is offered, which is NOT supported by trial testimony. They go completely silent. Then, it's OK.

Gotta know all the facts. She (the accuser) apparently didn't know he (JJ) had been drinking and she (the accuser) testified to that. He (JJ) had her (the accuser) come pick him (JJ) up but apparently never told her (the accuser) that he (JJ) had been drinking.

My information came from listening to the testimony in the court room. Your information came from an inaccurate and incomplete Missoulian article. It looks like you ought to obtain your information from better sources.

My information came from listening to the testimony in the court room. Your information came from an inaccurate and incomplete Missoulian article. It looks like you ought to obtain your information from better sources.
