As a father you have to agree with that. When there is no physical evidence due to a lack of timely reporting we are often left with these he said/she said situations. It's often a vexing problem even with physical evidence and prosecutors have to make decisions about consent. The book aside, this is far from a black and white argument.

Better late than never Mr.T. I wasn't going to say anything but Ursa touched me inappropriately many times over a three year period. I'd like to see him band for an additional week based on the mental trauma he caused me (and who knows how many others).

I cannot express to you my thanks for coming forward with this. Your courage and honesty is truly inspiring! I too have been touched inappropriately by Ursa many times. For the past 35 years he has treated my body like his own amusement park. I can only hope that eventually justice is served upon this monster, in this life and the one after. God may forgive him but I never will! I hope he burns in hell.

I wonder if the book points out JJ's accuser is no stranger to making these allegations and also got her high school teacher fired for the same false allegations...She's mentally ill and anyone who knows her or is knows this case outside of the Missoulian "writers" will tell you that. Even her close friends. Funny how all the women making false allegations get a free pass with you guys)

Re: the "Couture" approach to handling "hearings," as well as the handling of "evidence and testimony." The approaches used in these cases mimics JJ's hearing, and is now the standard at UM and other Universities, thanks to DOJ's successful bullying of Engstrom into signing the "model" settlement that he later admitted (to a Kaimin reporter) that he hadn't read.

Take contact between the two parties after an alleged incident of sexual assault. Even if the accuser appears friendly toward the eventually accused, all they have to do is claim their messages didn’t accurately portray their feelings and suddenly, those messages are used against the accused.

This occurred in the Emma Sulkowicz vs. Paul Nungesser case. After what Sulkowicz claimed was a brutal rape in which she was pinned, beaten and choked before being raped, she sent Nungesser numerous messages asking to hang out, even telling him she loved him. Nungesser tried to get those messages introduced as evidence during his Columbia University hearing, but was denied. Nungesser, who has since become the victim of a public campaign of defamation by his accuser, was exonerated anyway.

After Sulkowicz began a mattress-carrying performance art project and publicly identified Nungesser as her attacker despite confidentiality rules, Nungesser released the post-alleged-rape Facebook messages.

Sulkowicz responded to the released messages by claiming she sent them because she wanted to have a “talk” with Nungesser about the encounter. Some people still buy it.

A similar situation played out at Vassar College when Peter Yu introduced Facebook messages showing his accuser apologizing to him for the evening. She apologized for leading him on and said that she had “a wonderful time” with him.
