NCAA sanctions: A different perspective...

The point of my previous post is that MSU has in the past and still does have issues and potential NCAA violations. I hope they don't have the NCAA camp on campus and do a rectal exam similar to what just happened at Montana.
In looking at the recent past there are some very serious issues and criminal activities going on in kitty land. Scott Ash is an indication of the mentoring and discipline talents of his parents. He is an extension of all that is RAsh.
I really can't wait for the season to start because it's going to be a great year to be a Griz fan. It'll really be interesting to see how MSU does against the National Champions in Fargo this year. A game like that so early in the season should tell us just how good the cats really are.

When did MSU have NCAA violations?

Pamphlets absolutely went out. If you're a booster you should have received one. You could have saved some on TP.
 
The NCAA, about 99% of the time, is completely out of line and looks like it will do anything to show schools it still has power. The meals issue is a complete waste of time and resources, but it underscores just how much the NCAA is unable to find a legitimate issue to regulate. This is an American institution that can ruin schools, levy taxes on entire states (see Penn State) without authority to do so, and is overseen by absolutely nobody. The real problem the NCAA has is that it makes billions of dollars off of student athletes - and if those athletes are later unable to make millions themselves or get a college degree, they are on their own. This is the true crime of the NCAA -they profit off of an athlete for 4 years and then kick them out of the club. If the athlete falls to the curb or rises to stardom, it isn't even guaranteed that they will have a college education to show for it.

The attorney fees issue, while important, shouldn't be something for the NCAA to regulate. That student athletes got discounted or free legal fees is not solely an issue of competition but rather an issue of equal access to the legal system. Even the most intense Griz fans will have to ask themselves if a two-year starter on the volleyball team would get the same access to stellar legal representation as a star defensive back and current NFL player. Therein, in my opinion, lies the problem and a justification for scrutiny but not a basis for punishment.

I think equal access is the point here, the NCAA felt that they got preferential access to the legal system, nobody is claiming that they don't have a right to counsel, but boosters shouldn't be providing legal counsel as a perk of being on the team.

Do you see any reason why an athlete shouldn't be able to have a case taken on a contingency fee basis, if the general population could/would have a similar/same case accepted on a contingency fee basis? I'm told the facts, including audios and witnesses, would be very supportive of a civil case against the police.
 
Criminal defense cannot be taken on a contingency basis, no exceptions. If it is a civil suit that's a different matter because ultimately the burden is on the attorney to make good business decisions and take cases that have a chance of being winners. The status of the athlete at that point would mean much less, because regardless of volleyball or football, the athlete would be judged on the merits of the case and the lawyer would still have the burden.
 
my different perspective is we should've taken a one year playoff ban instead of what we took. get it over with and move on. we now have this crap hanging over our heads for three (4 actually) years. our scholarship allocation is:
2012 - 59.27
2013 - 61
2014 - 59
2015 - 59
2016 - 59
2017 - 63
we won't be back to full until the 2017 season and only happens IF we don't violate our probation.

Why punish the current players by accepting a one year playoff ban when they had nothing to do with what happened in 2011? IMO, the loss of a few scholarships for 3 years probably won't be that big of a deal.

The law firm said, according to the report, said: "she was also representing the student-athlete on a contingency fee basis in a potential civil lawsuit against the local police department and reported that she repesented the student-athlete in the related criminal case without charge in consideration for him retaining her to represent him in his potential civil suit." The law firm also said they were using the criminal case to evaluate and set up the potential civil case. I am told by lawyer friends that it would not be uncommon for law firms not to charge for the criminal part of a matter is they were looking at or planning a later civil case on a contingency fee basis.
 
Regarding legal fees for the criminal work, isn't it fine for the fees to be paid later in the case, or when the case is over. If the athletic department inquired immediately about payment of the legal fees, the answer might have been: no, we haven't paid them yet because we haven't gotten a bill, but we'll pay them later when we get a bill at the end of the case. The case was finalized after the season.

$1500.00 a year just so we can pay $192.00 per seat for the season in the gold section. I truly don't remember getting a pamphlet. I'm sure I just tossed it in file 13. Sure wish I would have taken it into the office can. That's how much I like the ncaa. I hope we never see those pricks in the great state of Montana again.
