JJ Trial

I would think the Prosecution would need to be WAY ahead at this point (to the point where the jury is ready to convict if they took a vote right now), as they have put on most of their case. The defense hasn't started their case yet.

I've been following this case closely as well, and so have people I know in the legal profession and no one thinks it's going to be a conviction. Right now the prosecution should be way ahead and everyone should be convinced, the defense hasn't presented their case yet at all. However, my feeling and those I've spoken with is that if the defense did nothing the jury would come back with a "not guilty" verdict.

The victim's testimony and her responses during cross were not convincing especially to meet the criteria of reasonable doubt on the third factor that must be satisfied - did Johnson know that she didn't give consent. Her testimony was that she playfully said no, then proceeded to take her clothes off, then flipped herself into position for him. And that's her testimony. Coupled that with her inconsistent statements, roommate being discredited on stand for similar inconsistent statements and this frankly doesn't look good for the prosecution.

Hiring an attorney and Paoli sending out a PI before he was accused INCLUDING the retraining order would seem to me to not only suggest that JJ knew something was up but also may have been the thing that helped the girl to decide where to go with this.....

In any event this trial won't be finished. A mistrial is coming very soon. Paoli and Pabst's concern with the firings is going to cross the line....

That and her telling loads of people JJ "raped me" might make him need to be proactive. For someone terrorized as a victim she certainly felt comfortable telling about everyone she could think of about the "alleged rape".

Does anyone know what the letter contained that was referred to? I had the idea she told him what was up in that letter. My guess was that was why the P I was dispatched....lot of surmising on my part tho.

Would depend on the vote count for conviction vs. acquittal. My guess would be with a hung jury the majority would be voting for acquittal. With no prior history and a 20 year old I say the odds are extremely remote.

This case lost all rationale after the judge issued restraining orders on both parties.

Nothing to do with the trial, but to Kids that age, it is a handful. Think of the Notre Dame fb player who never met his girlfriend but was devestated with the break up.... Not to mention this whole hooking up thing.

I have no idea of guilt or innocence, wasn't there. But the PI thing does bother me a bit. HOWEVER, the PI was retained by Paoli after Johnson hired him after he received a notice of charges from the Dean of Students. So no police report yet, but the school judicial system had already begun.

Except that for someone to say they don't want attention or to play the victim it seems like a lot to me. It appears that all it took from her was to appear sad and when someone would ask what was wrong...."Oh, I was raped". Just seems a bit fishy to me.

I don't think this point holds much weight, perhaps it speaks to the motivation for JJ getting an attorney, I know I would if it got around campus that someone said I raped them, however 30-40 people is pretty much everyone you know. Especially for a self described 'shy girl' 30-40 is alot of people. But there's nothing wrong with telling everyone per se.

That could be, but someone would have to know her to ask and know her well enough to see a difference.... Doesn't mean it didn't happen, and no reason to think if it did happen that she wouldn't want some help and support from her friends....

I won't accept any decision...the judicial system in this country is a fucking joke. It's slanted to help those who "need" the help. Political correctness at its worst.

agreed...couple of my attorney friends have told me that there is no way in hell a jury will convict. A full acquittal they weren't so sure on, but a conviction, they'd bet the farm that it won't happen.

Ya, I can kind of see that side to. Just not sure what to make of it all. I just don't see the "smoking gun" yet by I'm not in the court room either.

Absolutely agree. My fiance, her mother, & her roommates who are nurses agree that she crossed ethical & professional boundaries once she began texting her... IMO it was at that point that Ms. Doe is no longer considered a "patient" like the nurse described.
