Thank you. Someone finally sees the real issue here. This has nothing to do with being a cat fan. I actually think his athletic penalties are fair enough. I have no problem with that. The problem I have is with getting out if a DUI. If you choose to be an idiot and drink and drive, then you should not be able to plead down. Mt is the #1 state in the nation for fatalities due to drunk driving.
His actions could have easily taken the lives of someone you know and we just slap him on the wrist. Our laws and attitudes toward all this need to change.
The laws had already changed just prior to his arrest. 24/7 Supenas for blood tests are and were avaiable then just as they are today. But the cops thought they had a slam, bang in the bag case and they didn't bother make a little phone call & do the paper work needed to prove it and gather the needed facts in this case.

I believe that is incorrect bearaxed, however I could have misinterpreted the new law just as well. The new law only applies to those who have a previous or pending DUI or have refused a blood-alcohol test in the past. Did Maus have either of those?

In my opinion too many people beat the system these days and this is just another example. For a guy that saw Maus out that night.... I can tell you he had more then a couple.

lol - well it's going to be tough sledding for him as he joins the best stable of linebackers in the Big Sky. He's going to probably be back running with the frosh on the fuji and scout team stuff. I see him as a special teams contributor for sure. Last year he was working his way in and showing promise but it all depends on what kind of shape he's in starting next week.

You've got Tripp, JP, Stu, Coyle, Owen, Holt, & Richards who would all be in front of him, not to mention a slew of new 'backers showing up in this year's recruiting class.

Seems to me that if the kid pays his 'debt to society' he should be able to play. I give him a lot of credit for committing to speak to the middle and high schools, now he needs to complete that task.

But his actions did not cause any of that. You can't judge and penalize based on "what may have happened." That red light you ran yesterday (hypothetical) may have caused you to run into another innocent driver (Failure to Yield to Official Traffic Control Device), that yield sign you ran may have caused you to hurt an innocent driver(Failure to Yield), that cd you changed while driving may have caused you to run over a pedestrian (Careless Driving resulting in serious bodily injury or death). You get my point.

Prosecutors, defense attorneys and judges deal with these things every day. They look at all the facts, past criminal history and make determinations as to what best serves the situation and justice. There is no one size fits all in theses instances. Let them do their job and take off your black and white glasses. Life has many grey areas which you may discover when you make a discretion, big or small. :thumb:

So you are saying it is okay to drink and drive as long as it is a "no harm no foul" situation? Take these 2 situations and you tell me the punishment...

1.) Drunk Driver A (.16 BAC) drives home and crashes into a tree 1 block from the bar.
2.) Drunk Driver B (.16 BAC) drives home and crashes into a 5 year old girl before hitting the same tree.

See my point now? In some sense we have to wait until something bad happens before we as a society demand justice. I honestly hope that Mr. Maus takes advantage of his second chance and has learned from his mistake.

Also note that I am not calling for his head or anything, just showing the flawed logic on something that is a major killer in the US (especially in MT).

My rant is off...

Nope I didn't say that at all, not even close. And yes, you are calling for his head. The penalties were levied and they didn't meet your approval because they were not stiff enough. Drinking and driving is not acceptable. But you can't base penalties on hypothetical s. They have to be based on the facts of the individual case.
 
FWIW he got wacked a lot harder than the average DUI in Missoula (even a second or third in way too many cases) and whole lot harder than the average player has in the past. He lost an entire season, remember there are other sports beyond Football.

If this was "stupid" he deserves a second chance, if he has a drinking problem it will come out and hopefully within the year so it can be dealt with.
 
Maybe if the Griz football program took a tougher stance on underage drinking a few of these ugly events may never have taken place. Sometimes it takes a sacrafice to put the scare in them.
