They didn't even "break and enter," they just climbed up a ladder that happened to be there, into an unfinished building project. Sounds like they were waiting for their ride -- no DUI's -- and thought they'd take a look.

As the homeowner noted, they probably didn't realize that the renovation project was not freestanding, but attached to an occupied house.

At the worst, this is misdemeanor trespass, on Halloween. When I was a judge, this would have been a 6 month deferred imposition of sentence, and then dismissed. Not to downplay the fact that Griz players have to meet a higher standard, and this was just unbelievably stupid, but there just doesn't appear to have been a criminal purpose here.

From the Kaimin article, I doubt that the homeowner will want to press charges, and in that case there would be no prosecution, but in this case the decision becomes a political one as to whether to charge them or not, because of who they are.

The men, who police believed had been egging houses, were running from police at about 3:45 a.m. when they crawled through a basement window into Krauss' southside Park Place home, Bozeman Police Sgt. Steve Crawford said Tuesday.

The commotion woke Krauss up, and he went downstairs to find several people running through his house, he said.

&#8220There were only two coherent things I heard, 'Stay down,' and 'Running north,'" Krauss said. &#8220It was pretty startling."

In the darkness, the mayor said, he couldn't tell who was speaking or who was running through his house. He later found out the speaker had been Bozeman Police Officer Cody Anderson, who was pursuing the men.

MSU freshman football players Clay Bignell, 19, of Avon, and Daniel Ogden, 18, of Kalispell, were charged with misdemeanors in connection with the incident, Bozeman Deputy Police Chief Mark Lachapelle said.

Three other freshman students - Robert Schmechel, 18, and Tyler Haven, 18, both of Kalispell, and Miles Wahrer, 18, of Bozeman - also face misdemeanor charges.

Allen Yarnell, MSU's vice president of student affairs, could not be reached for comment.

According to court records, Bignell appeared in Bozeman City Court Monday and pleaded guilty to criminal trespassing and obstructing a peace officer, both misdemeanors.

During the chase, the men also broke two fences and damaged an outdoor shed, Crawford said. Five separate homeowners told police they found property damage to their homes.

On Monday a young man stopped at Krauss' house two times, asking if he could come inside to look for a cell phone that &#8220his buddy" had lost, Krauss said.

The family turned him down the first time and called 911 the second time.

The mayor applauded the police response and said he hoped the arrests sent a message to would-be criminals that &#8220if you run through somebody's house, you're going to be prosecuted."

Entering someone's home is not to be taken lightly, he said. Plus, chasing down people for egging homes takes up valuable police resources, Krauss added."
 
Even with the updated information provided by the Kaimin,guilty or not guilty of the charges, after the crap the GRIZ went through the last several years, I would kick them off the team permanently!!! To me, it is more about being committed to your team and the university than what the actual story is.

Their actions were stupid, selfish, and careless. These are young grown men making the decisions of a 10 to 15 year old!!!! There is no excuse for being out that late and putting yourself in that kind of situation. Regardless of their intent, they blew it!!! I cannot comprehend how anyone with any kind of education at their age can be this stupid!!!

I feel Stitt or any coach has the right to go beyond university guidelines to discipline as necessary. Even when I coached AAU basketball and little league, we made rules for the players. They were not to get into any kind of legal trouble, expected to attend classes, respect adults/authority figures, respect one another, be on time, and basically stay out of trouble. Amazing enough, in several years of coaching kids with these simple rules, not one time did we have to kick a kid off the team. The only problems we had were kids being a little too vocal with officials and/or the other teams, now and then. The most we ever did was bench a player. If 10 to 18 year olds can follow simple common sense rules, why in the hell can't college athletes? Sorry, but to me they had to break some sort of team rules here, and I do hope Stitt makes a very loud statement here, ZERO TOLERANCE, you are off the team!!!!!

Well good morning to egriz. I see the holier than thous have tightened they're halos and have googled things like burglary, and are ready to let main hall, and the courts how to "punish" these guys. "Off with their heads" I tell you. The hypocrisy on this site sickens me not to mention the level ignorance.
I consider myself relatively high profile in my community. A few years back a well to do friend of mine were taking a walk and noticed a house that was being built. A level of curiosity drew us into the structure because we wanted to see how things were being done. We walked around it for about an hour and left. We're there tools? Yes. We had no intent on taking them but my friend (who builds homes) mentioned how easy it would be to take things and the contractor should secure them better. I don't feel I was a burglar.
My question is what we're they doing right before this? Waiting for a ride and happened on a structure.."hey let's check it out." They're ride said she wasn't aware of wrong doing. OR did they knowingly trespass with intent to commit a crime? Yes it makes a difference to me. The lives of 3 young men who proudly put on Griz uniforms are in a pickle and I am not ready to cast them aside because of others discretions. These are case by case situations.
As far as they should have gone home goes. Probably true but that is no reason to say they are selfish and aren't worthy to put on a Griz uniform. I guarantee other players were awake at 3:00 am doing things that can be construed as "selfish."
Let this thing play out before throwing stones that are otherwise good kids and quit buying into what the public eye might see. Nobody wants their kid to be made an example of. Especially when facts MIGHT suggest otherwise. Being a Griz Fan for a long time I'm of the opinion these kids deserve a fair trial not an EGRIZ lynching.

Even though I believe it happened during the off-season, I believe they lost scholarships and had one year suspension.

"Said Cathy Conover, MSU's chief spokesperson. Bignell and Ogden are on probation for one year and will not be allowed to play football during that time."

Finally a little bit of sanity. Actually I too walked through a house under construction with a friend out of curiosity. I believe it was the morning of a Griz game. It is possible that they were getting out of the rain Sunday night while waiting for a ride or they were going to rape and pillage, we don't know.

It's a guy thing. I've done it a number of times.

Three tired guys, after a long, frustrating road trip, on Halloween night not thinking too straight, but that was about it.
 
I can hear the lawyers lining up now a state away. Doesn't matter what they did or did not do. The lawyers are already on it... They will find an out. No worries the glove doesn't fit.
 
Omg. Getting out of the rain at 3am. I have had homes under construction my entire life while living in them. If I awoke at 3am and found 5 huge men in my property their stories would be over. What are these guys "looking around at" at 3am. No lights. Had to climb a ladder for gods sake. I also have walked through construction DURING THE DAY. Didn't have to climb a ladder. Was looking to see how they were building. No doors on the place or windows. Construction tools are pricey and can be pawned to help pay for miscellaneous recreation habits.
 
There's a big difference between "trespassing" or "criminal mischief" and "burlary".

Those wanting to just summarily execute these three are assinine.

Agree with the last sentence, we'll see how this shakes out.

But, all three things in your first sentence are still crimes. They shouldn't have been there. They definitely shouldn't have been in the middle of the night. Just nothing good about this thing...the fact they are upperclassmen extenuates the issue in my mind.

Who knows what the crime will end up being...if anything. Safe to say at the very least, they are in the Stitt House, perhaps forever.
 
Calm down all of you. Remain calm and continue to think while being calm.

It will not matter concerning the remander of the season one way or another. Shoot these guys or let them play?

If they do not end up playing it won't matter because the team is NOT good enough to play beyond the end of the season with or without them.

Harm to the program? Some, but it will soon pass as far as the next few seasons go. So calm down and quit shooting these guys and wait until they are found guilty or not guilty in court. And then later in Stitt's court!

A few thoughts. College kids, including college athletes, stay out late, and they drink and party. Not all, but most. It's just a fact of life. It's nothing new. It's been that way for a long time. It's naive to think otherwise. It's virtually impossible to change.

I don't know the facts or intent here, nor what the house and house renovation look like. However, if it looks for like something that is being built, and is somewhat open, that would influence my view on this. People, including many on egriz according to their posts as well as myself, have walked into houses being built multiple times. Sometimes an unlocked door had to be pushed open. Maybe a barrier had to be pushed aside.

According to the owner, nothing was taken or damaged. The owner said this: “I hope they’re not guilty of much more than being extraordinarily stupid.” That is meaningful to me.

I know people who know Van Ackeren very well. He is apparently a terrific kid. A very good student.

We'll see what the facts are. Maybe they will support more serious charges; maybe they won't.

You're gross! You dont go walking into any house that under renovation, especially that time of the morning.. They're lukcy they didnt get shot!
