NIL and Title IX

If what I understand is correct, this applies to NIL paid directly from the school (as part of the $21M maximum recently allocated to each school).

NIL paid from private sources like a collective would not be required to be equally split.
 

Thought people who were speculating they could use most of this money on football were dreaming. None of it makes the NCAA or big time intercollegiate athletics look like they have a shred of integrity. I recall them having a couple fans grabbing cash strewn about the arena floor at Griz bball halftime, kind of like it on a much larger scale.:(

For now but you know some enterprising attorney is making plans. That those involved seem to not care how this looks to the public who they ultimately rely on for their revenues and support is somewhat puzzling.:eek:

Brother, private NIL is based on services provided in the private sector, you're talking about the end of capitalism if that somehow gets equalized in the courts lol

You seriously believe that there is some standard for "services" rendered with NIL or that some legal eagle can't find a tid bit of law to claim his client is being unfairly treated? I don't have a problem with a kid benefitting from his/her talent, the problem is the lack of transparency in the whole process. It's pretty telling that those involved like it that way. Which is perfectly fine in a private transaction, yet these seem to be significantly tied to (mostly) publicly funded entities whose stated purpose is to further the public interest.
Maybe the best thing would be to have the athletic departments be severed from the institution and run as an openly profit focused entity. I'm talking the big boys here, not UM. Right now they have one foot in the for profit world and one in the "public interest" world. And they use the public's support for institutions to personally profit. So who calls the shots, the institutional leaders or the AD? I personally hav.e no dog in the hunt, just think it should be out in the open because it's not at present. And when a UM is deciding on things like moving up in football an informed decision needs accurate information.

My point is that as long as it's outside the school, what are you going to tell them?

"Hey, owner of Brettz RV and Marine, I know you signed an agreement with Eli Gillman, Junior Bergen, and Trevon Gradney to promote your business in exchange for NIL money, but actually you have to employ and offer the same compensation to 3 Lady Griz basketball players, too, even though your private business isn't subject to Title IX"?

I'm not opining on what I think should be the case, or whether I like it or not, but this is the reality of how it's set up right now. As long as outside NIL is legal (and I don't see that changing anytime soon) the Title IX stuff will only apply to payments made directly by the school, itself.

Is this one of those ah-ha moments where everyone realizes that the ncaa has had no legal control the entire time?
