The Federal Government long ago recognized that "human rights" claims had to be filed within 180 days because of the transient nature of the evidence involved in such claims. That the defense was entitled to the presumption because the defense was most likely to be prejudiced by the expiration of evidence, the loss of materials, the dimming of memories, whereas a presumptive victim was always in the position to retain necessary evidence and therefore always at an advantage if the claim were true.
