I am sure one of the "lawyers" on the site will correct me, but what exactly could he sue the university for? Taking a rape claim seriously? As unpalatable as it might be to some of you, but most normal people expect a rape claim to be taken seriously.
Or is he supposed to sue for the expulsion that doesn't seem to have actually happened? It seems like he would have a tough case to even prove any injury. Even if they could prove that the honor court was rigged it doesn't seem to me that they have done him any real injury.
There are clear rules that he can't be on scholarship while being charged with a felony, so I can't see where he has any recourse there.
And suing the Missoulian? Well, lets just remember that slander is very difficult to prove, and in this case I certainly think there have been some articles in the Missoulian that have shown some bias, but that is way different from being slanderous. I think Jane Doe would have a better chance of suing some egriz posters than Johnson would have suing for slander.

A lawsuit against the university would likely be for damages and an injunction to permit Johnson to remain in school and play football. The claims would include violation of civil, constitutional and contractual rights, due to a biased, flawed and inadequate investigation, failure to provide to due process (required by the US Constitution), and failure to follow university procedures (this is the contractual aspect). A key aspect of the claim would be the university's reduction of the standard from clear and convincing to preponderance during the course of the proceeding. A federal judge has already said the university's action were lacking an unfair.
Most people expect the university to conduct fair investigations, provide due process, follow their own rules and procedures, and comply the federal and state constitutions.
You may want to work on gaining a better understanding of the law, the constitution and the facts of this situation.
