Right, he is saying that RE didn't do enough to combat the rape culture on campus in regards to the Saudi student, but he is doing too much to combat the rape culture in regards to the football team, and that is why students didn't come. Not to mention that opinion from a federal judge that was tucked away in a download from a newspaper article about a motion about something or other (a month or so before the beginning of classes?) that surely highschool students and their parents downloaded and understood all (20, 30, 40?) of the pages.

Look, I know RE is a favorite punching bag, and Griz apologists love to kick him around, but there does come a point where the blame becomes a bit nonsensical.
 
Ok...point taken. Doesn't a problem with leadership then go all the way to the top? Though I understand there is more than one cause to the problems, with a big one being rumor mongering.
 
Well said 75. I don't think the Missoulian accurately reported the judge's ruling, though. And because the Misdoulian bungled its report, only readers who scanned the pdf attachments stood a chance of understanding. How terribly wrong Engstrom's actions were.

Its sounds all well and good, but admissions happen before March (if they plan on any financial aid) well before the firings and pretty close to the "report" release. The decision to enroll (or not) were made in the fall early spring before.

In the years prior to this all happening even BW couldn't make the claim of Non traditional student because there were far more far more non-traditional. The place was crawling with displaced mill workers and other laid off from associated businesses many in their 50's using their 2 years of free retraining..... That money ended.

The fact is if the enrollment bleeding slows down or even reverses with a slight uptick the next 2 year RE will be hailed as a hero.

If you believe a Missoula federal judges opinion (which was highly conditional to begin with) will change how the DOJ and Title IX are handled and administrated, think again. The honor Courts aren't even necessary. The Schools right to "expel" almost at whim has been held up more than once.

The ninth circuit would be more likely to give the Honor courts the right to impose the Death Penalty for these "incidents" than restrict their operations.......
 
Federal and state due process rights apply to public universities. This is firmly established in federal case law. The important question is what is the extent of the due process rights in university disciplinary proceedings (it is something less than what is required in a criminal court case). In addition, universities must adhere to the procedures in their honor codes. A federal court outside of the 9th circuit had held that a university must allow the accused's lawyer to participate fully in the panel hearing, if the matter involves a potential criminal matter. Johnson's lawyer was not allowed to participate fully in the hearing.

The federal judge in Missoula said the following, in an order issued prior to the honor panel hearing last spring. This was prior to the University's new lower standard (preponderance) being used in the proceeding. It is possible, in fact likely, that the judge would have been further offended by the use of the lower standard, which had been changed during the time of the investigation.

"Today's ruling is not a finding that the process employed by the University in this case is immune from legal challenge. Indeed, from a normative perspective, the process applied to Plaintiff Doe and the behavior of University officials in investigating and prosecuting this matter offends the Court's sense of fundamental fairness and appears to fall short of the minimal moral obligation of any tribunal to respect the rights and dignity of the accused."

"In light of the manner in which University officials have apparently conducted their investigation, there is no doubt in the Court's mind that the public interest favors an injunction. But the standard for injunctive relief requires at least a showing of some possibility that the Plaintiff might succeed on the merits of the claims as pled."

"The Court states no opinion on whether other avenues of recovery may exist or may materialize in the the future ...."

Does the addition of Curtis White, JJ's former high school teammate, sway anybody's opinion if he will return? I seriously doubt Curtis would transfer here if JJ had no intention of returning to the team after his acquittal. This makes a strong case to me that JJ plans to play.
 
I've said it before and I will say it again, unless UM prevents it, JJ will stay at UM if he is acquitted. No speculation needed.
 
I only know what I've read on the net. Been gone a long time, and don't know anyone involved in this matter. If acquitted, I hope he sues the shit out of anyone remotely related to this case, anyone posting anything remotely negative, the Missoulian in general, Engstrom, the University, the BOR, and the State of Montana. But, then again, I'm a really vindictive bastard.
