That's probably pretty close, except they probably are prepared to show that the alleged victims current state was the result of a fragile girl with known problems being assaulted. I would guess that despite a well written motion, the Paoli Pabst team is saying Oh shit, they called our bluff despite our dancing for the last few months, and them telling their client, "now I know we told you it was very unlikely that it would come to this BUT.............

I'm still hopeful it won't come to trial and this thing CAN be settled....

Actually, what has occurred is that Paoli/Pabst have called the bluff of the county attorney's office, and it appears to be an incredible bluff on the CA's part. Looking at the Motion indicates that Paoli/Pabst sure aren't bluffing.

How many times are you going to be wrong on this? Facing a felony, a good attorney is ALWAYS going to file a Motion to Dismiss. Plenty of other lawyers on this very board have said it's standard, yet you continue to live in your very weird bubble where what you say is the truth, and nothing else even registers with you.

Serious question ... do you have Asperger's? It's the only thing I can come up with that can explain not only your behavior on this board, but also your behavior in social circles in Missoula.
