UM's policy for the coming NIL law

State Senate bill 248 was approved this year, but will not be active until June 1., 2023. This bill will allow athletes within the state to profit from "Name, Image & Likeness Rights". However, there is a caveat for athletes from colleges like Montana and Montana State. That is, athletes from these schools must comply with the policies of their own university. Of course, a school which has a lenient policy with regards to NIL will have a recruiting advantage over a school with more strict NIL regulations.

I have not seen this discussed on egriz before. If it has been discussed in a previous thread, please provide that link for discussion.

Does anyone know if either UM or MSU has defined a NIL policy to date? If not, some of you insiders may wish to do some lobbying to make sure that we don't have a competitive disadvantage to MSU, or even other Big Sky schools with regards to NIL.

"Montana – Senate Bill No. 248 was approved this year. Effective June 1, 2023, the law will allow athletes to earn compensation from their NIL and to contract with professional representation from an athlete agent. Athletes may enter into contracts as long as those contracts comply with the policy of the individual athlete’s own university. The athlete may not enter an endorsement contract if that contract would conflict with the athlete’s own university’s contract with a competitor for the same product (again, think Adidas vs. Nike). The NIL law does not allow universities to pay athletes directly."

UM may want to consider making an agent available to counsel with potential recruits about NIL opportunities at our university. Lots to consider. I am sure many schools will attempt to find a way to gain a competitive advantage with these new NIL rules.
 
Players on the Griz have already signed NIL deals (sometimes multiple), so I'm gonna assume they already have something in place.

I thought that athletes in Montana had to abide by state laws, and Montana's NIL law doesn't go into effect until 2023?
 
I believe since that law has not gone into effect they must only abide by the guidelines of the ncaa and the university.

I have no idea, but they wouldn't be doing it if they weren't allowed to by the university/NCAA.

Sounds reasonable. Do you think that there could be an organized (and funded) NIL strategy by UM which could become a recruiting advantage, if it were more appealing to a prospect than other schools?

Thanks. I hadn't seen that before. So, within the UM rules for NIL, is there room for us to gain a competitive advantage over other schools? I still haven't seen a response to this question.
