Ulterior Motives(DOE and DOJ): Behind the Scenes Question

Diaclaimer: I'm in no way claiming that I believe this to have been the case.

With national and public pressure from the DOE and DOJ, is JJ's case an instance where the city needed an example to show rape cases are taken seriously? Did they figure it was a high profile instance that could prove to be something to point to?
 
If this case does ultimately go to trial (and I hope for the sake of both parties that it does not), I would certainly think that the "political" environment established by the Department of Justice "investigation" into the prosecutorial discretion of the Missoula County Attorney, would be a feature that the defense attorney would want the jurors to fully understand. It frankly casts a pall over the whole case, and ironically could be a major factor in the failed prosecution, if that is in fact the outcome.
 
if van whoever is filing this in order to look like he is zealously prosecuting rape charges, the doj investigation is deserved. his behavior up to this point indicates he wouldn't do such a thing due to his high ethics, according to... well... the same people cheering on this thread.

just sayin'.

The City is not responsible for filing the charges. The Missoula Police Department investigated the matter and turned their investigation over to the Missoula County Attorney's Office who then made the decision to charge JJ.

Can't say for sure, but I doubt any. The prosecution still has to go throught the same processes and have enough of a case to charge the accused. I don't think the fact it is high profile has anything to do with it. The fact that she had tests run the next morning that showed symptoms and has credible witnesses that are siding on her side of the story, I think the prosecution has enough of a case that, procedurely, they had to charge him (accused have been charged with less).

To be clear, in no way am I saying that I think JJ is guilty. I don't have any idea. From what I've read the defense will have their own case and possible witnesses to show innocence on the part of JJ. I just know that there is enough here for him to be charged and that the DOE/DOJ cannot press the County Attorney to single someone out to make a point. Not without violating statutes and procedure.
 
Keep in mind that Fred has so far stymied any efforts for the DOJ to do much with his office. That may have been a mistake, with time on their hands the DOJ went from 80 cases to over 500. How many made it to the County Attorneys office is anyone's guess. Any significant deviation fromtheir normal procedures would stand out like a beacon and make someone look guilty. But at this point there is no communication between the 2.

One of the TV News last night said the case was basically on the same time line as if they had charged earlier through justice court. Don't know if that is accurate, but make sense. If course if JJ is late on the 14th let alone misses the court date Paoli won't fare well..... lawyers don't often give a "personal" guarantee.

I did not read this before I made my post in another thread. This is exactly what I believe happened. I hope it goes to trial so JJ is proven innocent without people thinking he pleaed is way out of being charged etc. .
