This is a serious question: Why is it taking so long for these cases to come to trial? These are misdemeanor charges, right? There are several lawyers on this site who could tackle this question. Why? I'm not trolling. I am not asking for insider information. I'd just like to know what is going on, in all probability. :?:

Living in the area, I don't think it is uncommon for cases to take this long. I don't think the courts have kept up with the rapid growth in the Bozeman area.

It’s a fair point. A lot of the infrastructure over there was not ready for the growth that has taken place over the last several years. However, given the cost of housing, you think tax fees based on assessments would have the county drowning in money and given the clientele that has moved in you would also have imagine that there has been a powerful vocal minority to influence more growth and change than just in the airport and housing.

It’s likely the DA is just delaying trial pending additional charges. I mean, it’s quite obvious that Guzzlin Garza will wrack up at least a few more DUIs over the next few months. Why not save everyone’s times and combine those into me trial?

I guarantee the elitism in the Gallatin Valley is at an all time high.

Have been away for a long time - haven't been to bozo in many, many years. Just hard to imagine these folks - money and all - aren't bringing their politics with them. Are they escaping the policies they helped create to create the same policies in new places? Or, do they love their policies and hope to promulgate them elsewhere?

As far as I can tell, the charges are all midemeanors. City Court, aka Municipal Court. There is no excuse for an backup of cases. There is also no excuse for MSdUi not suspending all involved, until their 'due process' has run its course.
Back in the day, a third DUI conviction was a felony. Somewhere in the last 40 years,the Legislature changed the law. Brilliant!!! :roll:

As far as the Municipal Court, they are slammed with cases. The growth in the Bozeman area is off the charts. Cases are taking a long time to go thru the system. Not disagreeing on your other points.

it is common for cases to take an extended amount of time to get tried or adjudicated, nothing unusual about that. I don't ever remember 3 being a felony, you are probably thinking of 3 domestic violence charges being a felony. Speedy trial comes into play but both sides end up waiving the speedy trail. a speedy trial is like 6 1/2 months so again not sure this is unusual especially considering the case load on courts in any of Montana's bigger towns.
 
Well, I don't spend my free time( as opposed to my incarcerated time :lol: )sniffing around court rooms. Guess my traffic citation experiences, and the speed at which they were handled, as the norm. Pleaded guilty. I did it. Don't do the crime if ya can't do the time. Maybe the terrible trio could be sentences to mandatory watching of "Baretta" reruns as part of their sentences. Guess my I haven't made the Ten Most Wanted List, yet.

The third DUI thing was a fact, as I recall, in the early '80s. Any of you legal pro's with experience in the 70s and 80s could clarify this for y'all, or correct my misunderstanding.

The person’s driver’s license shall also be suspended for a period of 6 months, though the person may be eligible for a probationary, necessary use, license, subject to M.C.A. § 61-5-208(2)(b).
Possible ignition interlock requirement during the probationary period pursuant to M.C.A. § 61-8-442.

Jail time: 7 days – 6 months
Fine: $1,200 – $2,000

The person’s driver’s license shall also be suspended for a period of twelve (12) months and the person is not eligible for a probationary, necessary use, license, subject to M.C.A. § 61-5-208(2)(b) until ninety (90) days of the suspension have been served and the Court will order an ignition interlock.

M.C.A. 61-8-731: On a DUI Fourth or Subsequent Offense, a Felony, the penalties are:

Prison time: 13 months and up to 5 years suspended
Fine: $5,000 – $10,000
If the offender successfully completes a residential alcohol treatment program operated or approved by the Department of Corrections, the remainder of the 13-month sentence must be served on probation. The imposition or execution of the 13-month sentence may not be deferred or suspended, and the person is not eligible for parole.“
 
Wolf, thank you, but that is CURRENT law. What was on the books in 1980? I know the MCA titles have a history of changes made at the end of each particular title. Hard for me to do that on iPhone internet.
