What part of "without cause" can't your pea brain comprehend?

After the recent YC case, the ability of an employer to terminate an employee without cause no longer exists in Montana, except in the early months during any probationary period.

What I keep coming back to is that no one was fired. Their contracts weren't renewed. Both are still on the payroll.

If you don't have your job anymore, then you have been fired. You really are dense.

I know I shouldn't go here, but if you read this news release:

http://news.umt.edu/2012/03/032912stat.aspx" onclick="window.open(this.href);return false;

You'll see that the University has elected not to renew the contracts of the AD and HC. I'm not particularly dense, but I am able to "call a spade a spade"; neither the words 'fire' or 'terminated' are in the release. I'm not privy to inside info, but I'd be willing to bet both remain on the payroll as of today.

Have a pleasant evening - Go Griz!

Oh my. So I guess if your boss told you this morning that he "was letting you go" you wouldn't think you were fired or terminated because those magical words weren't used???? Regardless, I suggest you check out the Wednesday Missoulian article, which documented that the the board of regents unilaterally agreed to pay O'day another year's salary because "ROYCE ENSTROM DIDN'T GIVE O'DAY PRIOR NOTICE BEFORE DECIDING TO TERMINATE HIS CONTRACT." We can disagree all day long as to whether the firings were proper, but, my god, you must accept the reality that they were, in fact, fired. Even the U Sytem has acknowledged that, despite Engstrom's attempt to sugar coat it.

Lets go back to the original post. What if Pflu was wrong?

What if he was wrong? We're out a quarter back and his ill concieved public Statement wiould have ledd to his firing with cause and his career destroyed. Everyone considering hiring him would be aware of what he said and when he said it.

What if he was right? (and I'm hoping he is)

He said the wrong thing at the wrong time in the middle of a huge scandal facing the university virtually cementing the perception in the community and with females on campus the football team could do no wrong, and were having their actions covered up or dismissed. Lesser insensitive statements at the wrong time from those far mightier than he have ended careers. In Pflus case his public relations ability will be questioned but his coaching will not.

I hope he is right too. I always thought Pflugrad seemed like a heck of a nice guy, but always seemed to be a little awkward in front of the camera and his word choice seemed a bit off at times. He probably said the worst thing he could say at the absolute worst time. His comments did not help JJ out at all.

Funny thing about Pflu's comment towards JJ, is that in an interview I believe last week in the Gazette Delaney said pretty much the exact same thing about JJ. I'm pretty sure it was on the Cat-Griz insider, and Delaney was quoted giving high praise to JJ. In all actuallity I think people want to say this is the reason Pflu got fired, but it can't be if Delaney is able to say the same things without any ramifications, right? Wouldn't this scenario suggest something else led to Pflu's firing, maybe something nobody is even referring to?

I think this is exactly the case and why Engstrom is doing the right thing and saying nothing. If you have ever had to "fire" someone or "terminate" someone or "not renew their contract", then you know it is not an easy thing to. I don't buy the lone gunman arguement on Engstrom. I don't buy that he did it because someone else told him to. I don't buy that he acted without thinking it out.

Can someone (i'm looking at you tnt or PR) please explain the alcohol/consent issue to me because i obviously don't understand. Based on what i have read in this thread and elsewhere, it appears alcohol can vitiate consent for sex under federal law (title IX) but that's not necessarily the case for MT state law (rape)? In other words, a drunk can't give consent related to a title ix violation but may still give consent for purposes of rape allegations?

Title IX isn't exactly a "law" Its sorta like the Feds telling Montana we have to Have a daytime Speed limit or we Don't get any Highway funds.

Damn, those feds!!! My 1000 mile drive home use to 3 hours faster, than now. I would just time my drive to hit the Montana border right at sunrise, now it does not matter. I loved those days for long Montana road trips.
