Seems the only thing that makes the restrictions legal is if they are enforced equally and consistently, and the Allowing (encouraging) protest without restrictions while maintaining restrictions on other activities, including constitutionally protected activities seems problematic.

It would be interesting to see what the SC would have done if peaceful protests had been brought forward vs church attendance.

Enforceability is a whole other matter. I still contend these mandates are largely not enforceable.
 
Sometimes emails get overlooked. The Maves should have overlooked the health department email and played anyway.
 
Ha, Take it from someone who has to deal with the city/county of Missoula/ Missoula health dept. on a regular basis . It is amazing anything gets built and when it does takes longer because of the buffoonery from these so called officials .
.
Example, Did you know you need 3 separate inspections to pour a sidewalk ( city,state, county )/ and another two ( city / county )after you pour the sidewalk on a main street .
Health dept. Reviews on building plans take up to 6 months ????
Missoula and Bozeman are the absolute worst in the State to deal with .
 
I’m positive the athletic dept. is having discussions with the Missoula City County Health Department about the upcoming football season. Will be interesting to see how it shakes out. I mean with a 250 person limit what Tailgate area’s will be allowed? I believe playing this fall is hopeful at best.
 
I’m confident we’ll play football with fans in the fall. I guarantee you that the athletic department and health department have been in contact for months and are already working on a plan. Plus if what they’re saying is true about the virus fading during the summer, then we may not see many cases come the start of the football season in MT. We may all have to wear masks, and that’s totally fine by me if I can go see my team play. They’ll figure it out.

My understanding is while these mandates might not be enforceable if you are told to shut down and you don’t you are opening the door to future lawsuits if someone gets sick. Maybe player rep can comment on that issue. Being a board member on various organizations I know that scares the crap out of people trying to run events right now.

Another issue that has become apparent as several business, including several bars and restaurants, have found that ignoring the mandates could lead to business and liquor licenses being pulled.

The difference is in the 250 person "requirement". The County is interpreting this (apparently for the purpose of baseball and soccer only), as 250 people cumulative over the life of the event. I wasn't out there, so cannot say one way or another. But others said there were maybe 50-75 people at each game. The Mavs were clearing the stadium between games, and sanitizing. There is plenty of room for that few of people to sit far apart.

I am curious on how they are going to treat Little League baseball and softball, which is starting tonight. It will literally be played every night, on multiple fields, with far more than 250 people in attendance (cumulative). How about churches that hold multiple services on a weekend?

The email in question was sent (intentionally) at 4:56 p.m. on Friday. And the County is holding the lease over the Mavs. After the Mavs put up a brand new facility there (with $0.00 city, county, state or fed money).

I am concerned about the Griz games. With the current interpretations by the County, there is no way they will be able to play with fans, and highly unlikely they can do it without fans. High school sports also.

So maybe the question is , " is it written in licensing rules whether or not if you disobey a mandatory closure order can your license be revoked ." Also is the rule in question constitutional ? May need a lawyer to chime in here .
