JJ Settlement

I don't want to get too much into politics, but this statement coming exactly 215 years to the day that the US House of Representatives, on their 36th try, voted Jefferson and Burr into office is too much irony to pass up. You do remember Aaron Burr, right? As VP he presided over the first ever impeachment trial of a Supreme Court Justice Chase because he let his political feelings show through his court rulings? while VP he shot and killed former VP Alexander Hamilton in a duel borne out of political rivalry? Was later charged with treason? I think our forefathers would be proud that we are able to have peaceful elections and changes of government. As far as the honest of politicians these days vs anytime int eh past, you might want to research Montana's own Senator W Clark. the more things change the more they have stayed the same.

I'd love to know the circumstances. Maybe Duniway tried his best to hamstring the UM Bear Fighting Team by creating a scandal involving the star, F. Charles "One Ear" Maxwell.

I'm sure Krakwhore is in utter disgust over the settlement but it raises an interesting point in regards to his request for the school records. If Jordy had filed suit, then he likely would have waived his right to keep his student records confidential and they would have been aired to the public. I'm sure he and the University were aware of this. By settling on the threat of litigation, makes me think the University was much more concerned about the release of the records than Jordy. I'm sure those records would show (confirm) that Jordy was railroaded by a kangaroo court and further show the incompetency of Engstrom, et al.

If so, why wouldn't Jordy just waive privacy to the records?

I have to be honest, I kind of wish some of the politicians would have duels. It would set the pecking order a little better and keep people from running their mouth so much. Probably would help people work together a lot better...

A big yup, should have been wayyyyy more in my view! This rush to judgement of jj was from the start a ham handed operation followed by a piling on approach that not only damaged individuals but initiated a series of events that continue to damage a great school.....students and staff alike.

I don't know the answer to this, as I don't know the facts of the case (at least not beyond what's been written in the newspapers), but I just want to point out that the two things aren't mutually exclusive. The fact that the record might contain damning evidence against the University doesn't mean it might not also contain embarrassing facts that Jordy might also want kept private.
 
Personally I am surprised that both O'Day & Pflu have not sued over wrongful discharge.
 
I assume JJ would just prefer to have this episode of his life close, without additional and prolonged publicity. He probably just wants to move on and get a job, teaching apparently. Presumably coaching too. Releasing the file would result in additional and prolonged publicity, and more Krakauer crap. I can't imagine there's anything that JJ cares about in the file, as it all came out in the court case and the university proceeding information released by the federal court as of the time of the proceeding. Rumors are that the university, especially the 3 individuals, would not look good, tho. My view is that the university is correct, under federal law, in not releasing the file. On the other hand, I'd like to see the supposed internal university system memo detailing all of the mistakes of the university. I assume the basics were probably summarized in the dozen or so claims that are mentioned in the recent press on the settlement. I assume the accuser wouldn't be excited about the release of more information and more publicity either. At this point, I can't imagine that anybody involved, or maybe anybody else either, wants more information and publicity--except for Krakauer.

Plfu settled fairly early and easily to get clarity on what he was owed under his contract, and signed a release. I assume he thought it was better to move on quickly, and try to get another job. In retrospect, since getting new jobs hasn't been easy, perhaps he should have sued. I wish O'Day had sued too. Eventually, he probably just wanted to move on. It would have been interesting to see what came out in depositions of Engstrom et al, and perhaps the likes of Pat Williams. Litigation is often very distracting and upsetting, sometimes ugly, and time-consuming.
 
No telling how much the lawyers got for the civil case, although the usual fee would be between 30 and 40 percent of the recovery. Wouldn't be surprised if the remaining money went to reimburse his parents for the fees in the criminal case. I doubt JJ will be buying a big house and s sports car any time soon
