One thing I've learned from this case is that Beau Donaldson was a fool for pleading guilty to rape, because in Missoula, if you're a football player, saying no doesn't matter if you are a woman. It's whether or not the football player understands what no means.

You get a visceral reaction from this statement because there is a kernel of truth in there. Johnson first learned that the woman wanted to charge him with rape via a letter from the school and immediately lawyered up. If Donaldson had immediately gotten a lawyer and said nothing to his victim he absolutely would be a free man right now, there is no question.

No, I think Donaldson made a mistake by pleading guilty. It was a dumb move, IMO. I think a jury would have let him off. I don't think JJ raped the young lady, fwiw.

I don't think people should claim to know what all 12 jurors used as the determining factor based on one jurors quotes in the Missoulian, which may have just taken part of what she said in the interview and put it in the paper.

Where can I find this interview? Do I have to go to the Missoulian site to find it?

The real; problem is that while women's groups say all men are potential rapists, men should realize all women are potential false accusers. Even if you don't have sex, a few months later she can say you raped her, and you have to prove your innocence.

JJ's trial was a perfect example of using all the things the accuser did as evidence of rape. But if everything is evidence of rape, then nothing is evidence of rape as well.

this is a not case of false accusation. the police would've had to immediately prove that and have the accuser drop the charge, or they would have to charge the victim and take her to court and prove that she's lying, or she will need to admit to that. you can't say a not guilty verdict proves that the accusation is false.

the biggest piece of evidence against beau donaldson was his own words that were recorded by the police. he admitted to what he did. had he not unknowingly admitted to it, it's very unlikely he would've been found guilty. it's the only difference between it and the j.j. case.
