Are Player Payroll Records Published For College Players by School ?

I am sitting here in our beautiful corner office high above and overlooking Downtown Billings when an old friend/client in Boz Angeles, actually The Bridger Mountains, just e-mailed me the following question, " Just curious ...are the player payroll records published for college players ...and by school ?"

I e-mailed him back, told him that I don't know, but that I would post this on egriz and that I would let him know what I learned.

So, a little help ,
 
Great question - no doubt the coaches would prefer that the payments not be made public but I assume that UM, as a public university, will have to make those numbers available as they are now available for all UM employees. Sorry I don't know more.
 
Someone asked me this recently too. I don't know. Good question. Seems like money coming from a state entity/university would be public information. I didn't bother to Google.

After Thanksgiving 2023, I call up my friend and tell him " Let's celebrate our big win vs. The Shi__y Kitties 😸 in The Brawl. Dress up in your best GRIZ gear, I'll do the same, and I will drive up from Billings and take you out to lunch at Ted's Montana Grill in Downtown Bozeman."

So I did, he did, here is all of this maroon and silver in the heart of Boz Angeles with mini-Monte on the table. We received a lot of unpleasant, hostile stares and our waiter, after looking nervously over both shoulders tells us, " Look, I can't say this very loud, but Go GRIZ. !!! "

Fortunately, we both made it home--back to his " cabin " in The Bridgers and me back to Billings in one piece

Looking forward to reenacting that lunch again in Bozeman, late November !!!..

Looks like even if a FOIA request is submitted the schools are not releasing info. Interesting times.

What you, 717 and Hoops state about a public university having to eventually release their student-athlete payrolls makes sense to this layman--I am not a lawyer, but I know that Hoops is a veteran corporate lawyer and bond counsel for Dorsey and Whitney.

My hunch is that we may see the media --Lee Enterprises, MTN, SWX, etc. contribute to a legal pot of money, hire a First Amendment lawyer, and pursue the $ figures through a FOIA request mentioned by '95 and try to force the schools as public universities to release the payroll info both by team total and by individual player within the next year or two.

Because it matters how much is being spent to buy players. It effects the overall performance of a team. Which in turn can effect ticket prices etc. that the general public has to pay to support the program.
 
According to Haslem on the GFP, they will not be released and they are not considered employees of the University.
It will be interesting to see if the press, for example, challenges that. I never really gave it much thought until my friend emailed me these questions.

One thing is for sure: Marcus Weinel the head of our NIL, now is a UM employee since he's been hired as an Assustant AD. Does that make a difference in legal terms ? That I don't know--my legal knowledge is pretty much contained to watching " Law and Order !!! "

And as a nonlawyer, old's reasoning makes sense but so does what Elrod and Brint are saying: no effect on ticket prices, team expenses = none of our business.

I do know this: I am glad that I didn't go to law school--my grape is starting to really hurt with all of this serious, hard thinking 😕 !!!

If they aren't employees, their pay isn't something that will be disclosed. Just like we don't disclose their scholarship amounts. I don't believe there is any legal avenue that the press could even challenge for that information, but I am not a lawyer and would refer to those who are.

I don't think the fact that they aren't "employees" necessarily precludes the press from seeking the information. For example, independent contractor agreements with the state of Montana are generally subject to public disclosure. Moreover, the right to examine documents of government agencies is a constitutional right (Article II, section 9 establishes a presumption that all records of any governmental entity are open for public inspection). The right to public access applies to records that "are prepared, owned, used, or retained" by a public agency". The argument against disclosure would likely be that the players' right of privacy exceeds the merits of public disclosure. It'll be interesting if someone decides to push the issue.

Isn't a Montana university required to disclose all of the regular payments it makes? I can't imagine the city or county doesn't have to disclose financial information and payments. They are going to have to disclose the info sooner or later, is my view.
