So, once again, let's review the three steps involved in responding to any "news" story involving University of Montana athletes:

Step One: Shut the fuck up.
Step Two: Learn facts.
Step Three: Comment.

Besides, a great number of the counselors in town are kooks anyway. Fact.
Very true, I call it the Obama Era of entitlement. I would be embarrassed to ask for money at the expense of a few young men that happened to wake my family in the middle of the night.

I went back to read through some of the comments and right from the beginning you made the most accurate statement 75. Some of us made some bizarre comments, like one the cat fans gave a hypothetical that the girl was going to be raped. Some of you have more to deal with than these young men.

It's the "I'm tired of reading it but I can't stop reading it so I don't want anyone else reading it anymore either" logic.

Good result from the athletic dept. They followed the basic rules of the athletic code. They and Stitt must have also taken into account the very significant legal penalties and cost, and impact all of this must have had on the players. I can't imagine that this family will incur $16,000 of counseling. Just seems implausible. I think the police should have to pay for the gross over-charging of this offense. People have to realize that sometimes fairly simple and innocent actions can have large impacts, i.e. thinking you're going into an unoccupied area but it's actually occupied. Same with players doing seemingly small and simple things, but the things have huge impacts on them and the program. Note that they are not supposed to drink or go into place where people are drinking during the term of their deal. That will be significant for college kids. The tackle who got caught with a pill a few years ago fits into this category too. Glad this is resolved. Kudos to 75 for his terrific commentary, and for AZ and CDA for being early posts to suggest that other posters show down and wait for some facts. And thanks to myself for being right again on a legal matter. Just kidding.

And MTGrizRule should get the award for the earliest, longest, most useless diatribe and the earliest to grab the pitchforks and torches, ready to cast these three into the fires of hell knowing about 10% of the story.

The counseling damages awarded do not rise to that level.
Under Montana law, emotional distress is serious or severe, as required to support claim for infliction of emotional distress or claim for emotional distress damages, only if distress inflicted is so severe that no reasonable person could be expected to endure it. Ray v. Washington Nat. Ins. Co., 190 F.R.D. 658 (1999)
Under Montana law, tort of negligent infliction of emotional distress is limited to situations involving emotional impact resulting from direct observance of death or serious injury of close relative. Shupak v. New York Life Ins. Co., 1991, 780 F.Supp. 1328.
Watching some college students amble around in an empty room under construction on Halloween, from the safety of a nearby house behind windows and locked doors can't reach that standard. Evidence would have to be presented to the Justice Court on that claim, and none was.

Further, the Justice Court held that it could change the sentence to "deferred" after one year. No, it can't. It has no jurisdiction at that point to modify its judgment. These students are both misled and screwed.
 
Well maybe Paul Ryan isn't the attorney some think he is. However they did agree to the "payment" and except for sexual offenses, any record can be expunged in Montana
 
I see Missoula PD is incompetent at another part of their job: can't seem to shoot straight. MPD officer fires three rounds, close range, at wanted perp, and MISSES! Where did those rounds go? Need time on the range, as well as in the clsssroom! They just don't cease existing after missing their target. Approximately 180 grains at 1100 fps gotta go somewhere. This is more and more like a episode from "The Dukes of Hazzard." Daisy played by Courtney, the Duke boys played by the four, incompetent crooked Sheriff played by MPDs Chief, and Boss Hog played by the Mayor of Missoula. :lol: Life imitates art.

But at least they managed to nab the female designated driver in her pajamas, as she tried to get her friends into her car on Halloween. And then charged her with a felony and now don't have the good sense to drop the misdemeanor charge against her.
