I agree, and agree with the other recent similar posts in this thread. It would not be possible to build a case around what the owner said he thought he heard, unless the offenders admitted otherwise or there were other facts. Defense attorneys would pick it apart. The offenders would dispute and explain it. This homeowner doesn't seem like he wants the offenders to get into much trouble.
 
This is going to be a difficult decision for the County Attorney also. Sounds like it is a weak case, at best. So does she pursue a case she likely cannot win (never a good idea), or does she dismiss the charges, and take the rath of the "Oh, typical, Griz players get away with everything crowd"? And the latter includes most of the politicians in this town that she has to deal with on a regular basis.

Totally agree....and similar situation Stitt is in. Those three players really caused a mess for a lot of people

This is all I have to read. I am done with this topic. I am glad I didn't have to deal with this as a young adult. Years ago, me and couple of other young men including 2 from UM and 1 from MSU were working for Merrill Lynch in Seattle and we were downtown Pioneer Square having a few too many drinks after work. We decided to climb the side of a building so we could get a better view. Some building tenants called us in and the police questioned our intent and then soon let us go. If that was 3 Griz players in Missoula, that would be a sure arrest in these days.
 
Whatever Pabst decides, THAT will be the standard for all law enforcement responses in Missoula County even remotely similar to these circumstances. If this is felony level, burglary statistics for Missoula County and City of Missoula will skyrocket. All agencies have to keep crime statistics. It will make Missoula County APPEAR to be the burglary capitol of Montana, maybe the whole country.
County Jail will be bursting, will have to build a new one. So, next time you or your neighbor, your kids, or grandchildren get caught nosing around a construction site, they are BURGLARS. The future holds: $50,000 bail(get out of jail for a meer $5,000), attorney expenses, lost job and ability to get another job, probably bankrupt you eventually. All this is possible if Pabst doesn't just admit this is MPD overcharging.

Hmmm. I always thought some command of the English language was required to work at Merrill Lynch.

This is a common refrain when you find tools out in the open. Seriously, they are going to take a table saw back to the house or dorm room? And do what with it? Tell the RA they are opening a shop? And explain to their friend Courtney that they "need" this stuff?

Reasonable? Back when people were reasonable, no. This thread is proof that people are not reasonable these days.

Well, it is likely the homeowner would think a trial would be overkill, a waste of time, and may not even cooperate, if his analysis of "stupidity" is accurate.

Kirsten knows by now that this is a colossal waste of time and resources, and the only thing that keeps it going is the hot air of the disciplinarians, the sharia of sports. They must be PUNISHED! Say it with a German accent and it starts to illuminate the motivations.

But, she's been through the wringer with the politicians and social justice warriors (that was the point of that whole effort, make rational and reasonable people timid), and may bow and press charges.

As I mentioned, when I was on the bench, this would have been a guilty plea to trespassing, a fine, an apology, a deferred imposition of sentence, and in six months, dismissal. And that would have been done by this morning.

You know, if I was sneaking around intending to steal something, I probably would not be tromping around in full visibility of the windows, standing straight up, and talking loud enough that people in another house could hear me.

Instead, for starters, I would probably be actually "sneaking around," if I thought I was actually doing something wrong, or intending to, I would probably be whispering, crouched over, and not expecting my "ride" to pull up in front at any moment in full view of the street and all the houses on lower Pattee Canyon, esp on Halloween Night when there are people roaming all over the place.
 
this highly complicated detailed case has taken multiple days by Missoula's finest detectives to investigate before the attorney can make a decision on charges so who knows....(yes sarcasm)...more likely time for her to get ducks in a row to charge with misdemeanors and plan time to deal with the complaining. Like I said before they are in a lose/lose situation.....so is Stitt

It might all be sarcasm BUT you hit the nail on the head. RIGHT or WRONG, that is exactly why these are lose/lose situations, and why these kids need to understand they need to be veeeeeery careful. There are ramifications far beyond where they decided to wait for a ride (or whatever they were up to)
