Trump Considers Executive Order on College Athlete Payments

"The Trump administration is considering an executive order that could increase scrutiny of the explosion in payments to college athletes since 2021, after the president met with former Alabama coach Nick Saban, White House officials said.

Trump met with Saban on Thursday night when he was in Tuscaloosa to deliver the University of Alabama’s commencement address. Saban talked about “NIL” deals with Trump, telling the president how he believed the influx of money had damaged college sports.

Trump said he agreed with Saban and would look at crafting an executive order, people familiar with the meeting said. Trump told aides to begin studying what an order could say, the people said.

Saban didn’t propose ending NIL but “reforming” it, according to a person with direct knowledge of the meeting. He described how it was causing an uneven playing field, the people said, with an arms race among powerhouse schools.

The result is a freewheeling marketplace where nearly 4,300 Division I football players switched schools in 2024 and an estimated $1.67 billion changed hands in 2024-25, according to Opendorse, a platform that facilitates NIL deals.

“The people out there need to know this model is unsustainable,” Saban said in January on a radio show. He said it was unfair for some universities to pay and spend astronomically more than others."

Well that's interesting. Some of his biggest donors are probably donating to their alma mater for sports.

Wonder what an executive order for this would look like. Just as long as it helps fix some the problems then I don’t really care!

I imagine it would have something tied to federal funding. That's the only way to add teeth to it.

Probably requires Congress for real impact. Best impact might be to disband the NCAA and start over with a new governing body.

Maybe, but there are very few people out there regardless of politics, who think current NIL /structure of college sports is sustainable.

Something has to change.
Totally agree. Only ones who seem to be "loving it" are opportunists like sac. Programs with zero tradition and sustained success but can buy their way "up". Everyone else fairly universally agrees it's a broken system.

Wouldn’t a new governing body end up doing all the same stuff the NCAA currently does?

I agree with you that we need help from congress. The only thing I could see an EO doing is maybe help get the gears turning for congress to start working on new laws.

"Amid rising concern over NIL laws, Trump explores executive action to create federal guidelines for athlete compensation and recruiting fairness.

But what exactly would an executive order accomplish? Unlike legislation, executive orders cannot override state laws or judicial decisions, and future administrations can easily overturn them. They also lack the full force of Congressional regulation. However, such an order could set federal standards around contract transparency, disclosure, and oversight, curbing the more extreme state-level incentives that risk distorting recruiting and undermining athlete protections.

The NCAA has long called for a unified federal framework, arguing that operating within a fragmented system, where each state crafts its own NIL rules, is increasingly complex. Even in exploratory stages, a federal executive order signals that the issue is reaching new levels of national importance.

As legal cases remain unresolved and states continue passing their laws, the future of college athletics hinges on courtrooms and campuses and the Oval Office."

My only question is aren’t there more important things for the POTUS to be doing? You know, besides things that distract us from the real problems in the world?
Probably not. He's already worked on the Gulf of America, 51st State and Greenland. And upset the world economic order with tariffs and other things. About ready to give up on Ukraine, instead of ending the war in a day. Losing Musk. Losing most of the cases brought against him and his administration. Only had 143 executive orders so far. Working on becoming the Pope. Organizing the big military parade in DC for his birthday.

Sounds like he’s probably right on schedule then.

Why is it not sustainable? It seems like it's a free market system rewards the players. It's definitely going to create a tiered system where FCS is essentially the JV league. But why does that have to change and why is it unsustainable?

Why is Trump attacking true capitalism and free markets? Here's a shocker for those complaining about NIL in college athletics 'If you don't like how the market operates, don't participate.'

Because unlimited NIL, unlimited transfers, big money from big donors, bigger money from sports in college, etc. will ultimately hurt or even ruin college sports, result in more corruption and foster more cheating. In my view, this is not consistent with public or private universities. It’s becoming more and more outside the mission of college education.
