Utah St Football Coach To Be Fired - Title IX/Sexual Assault Failures

"Utah State has informed football coach Blake Anderson of its intent to fire him after an external investigation of alleged noncompliance of Title IX policies "that require full and timely reporting of disclosures of sexual misconduct, including domestic violence," it was announced Tuesday.

In a statement, Utah State said the investigation stemmed from "actions taken in spring 2023" that "violated both his employment agreement and university policy." It also alleges Anderson violated rules that "prohibit employees from investigating disclosures of sexual misconduct themselves."

Deputy athletic director Jerry Bovee and director of player development Austin Albrecht were also fired "for violations of university policies related to the reporting of sexual and domestic violence and failures of professional responsibilities.

Anderson has retained noted college sports attorney Tom Mars, who told ESPN's Pete Thamel that Utah State faces an "uphill battle" firing Anderson for cause.

"Stiffing a head coach by blaming him for what his supervisor was supposed to do is a novel approach, but that theory will never hold up in court," Mars said."


"In recent years, several Utah State players have been arrested for sexual assault or misconduct, the most recent of which came in July 2023 when Kingsley Holliday went to jail for alleged aggravated kidnapping, rape and forcible sodomy.

Anderson also dealt with some difficulties off the field during his tenure at Utah State. In 2021, an audio recording was released in which Anderson can be heard making comments about sexual assault, of which he later apologized."

Good grief.

It's not that hard, people. Treat women with respect, and definitely don't assault them; report it when there are suspicions to the contrary.
Okay, but the coach is being fired for investigating the matter himself, which is against policy.

"Like any university, Utah State could fire Blake Anderson for any reason as long as they paid his buyout," Mars' statement read. "However, based on the facts alleged and the language in Blake's employment agreement, USU is going to be fighting an uphill battle if they try to fire him for cause just to avoid paying Blake what he's owed. Stiffing a head coach by blaming him for what his supervisor allegedly failed to do is a novel approach that hasn't been tried before, but that theory will never hold up in court."

Okay, but the coach is being fired for investigating the matter himself, which is against policy.
He may have fired for other reasons too. I didn't make that clear.

"Utah State coach told players it’s ‘glamorized’ to be a victim
Anderson’s comments came from a team meeting during fall camp. According to the Tribune, Anderson warned players that they are “way more at risk” of being accused of sexual assault because they are athletes, and said that being a victim of sexual assault has “never been more talked about in the news [than] right now.

“And so you don’t need to put yourself in a position that you can create a victim,” he said, via the Tribune. “And it doesn’t take a whole lot. So it scares the s*** out of me.”
After telling his players to be “really, really smart,” he told them that it “has never been more glamorized to be a victim.”

Utah State University police chief Earl Morris warned players at that meeting that they should beware having sex with women who are members of The Church of Jesus Christ of Latter-day Saints, too, as he believes they’ll tell their bishop that it was not consensual.


“And if you’re not used to a Mormon community, folks, I’m here to tell you, the Latter-day Saints community … young ladies, they may have sex with you, but then they're going to go talk to their minister, their bishop, priest, whatever you want to call it,” Morris told the team, via The Salt Lake Tribune.
Morris was placed on administrative leave, and then resigned on Thursday."

"Total Salary Including Media Compensation is now as follows:
  • Year 1 (2021) – $1,057,692
  • Year 2 (2022) – $1,325,000
  • Year 3 (2023) – $1,375,000
  • Year 4 (2024) – $1,425,000
  • Year 5 (2025) – $1,475,000
  • Year 6 (2026) – $1,525,000
  • Year 7 (2027) – $1,575,000
  • Reduced the buyout amount if the coach were to terminate the contract from 75% of the “Cumulative Remaining Salary” to much lower set amounts that decrease each year as follows:
    • $2,000,000 before Dec 31, 2022
    • $1,700,000 before Dec 31, 2023
    • $1,200,000 before Dec 31, 2024
    • $800,000 before Dec 31, 2025
    • $500,000 before Dec 31, 2026
    • $0 before Dec 31, 2027
  • Utah State is still on the hook to pay 75% of the “Cumulative Remaining Salary” if they terminate the coach for convenience.
  • No apparent increases in the $2,500,000 salary pool for assistant coaches."
 
The USU Admin obviously haven't seen the MSdUi playbook on waiting for 'due process' to discover all the facts. Is Engstrom working in Logan now?
