So, during her closing argument Boylan starts off by saying "this isn't he said, she said" but then later, while discussing what constitutes sex without consent, she says that the two stories differ on whether or not consent was given. Nice contradiction there.

Edit: And, no, I'm not Fwen Glorio, who just tweeted the same observation.
 
Anyone else nervous as hell right now? Is it weird that I have butterflies? Can't imagine how JJ must be feeling.

I am not calling it a science just to raise hackle here... it is indeed a science...

Would I agree that it is not statistically reliable? No... I cannot say that as I do not know the scientific study and the data that was used to form the conclusions... But, we seem to come up with some pretty accurate polls without calling all 300+ million of the population...

But I can say this... IF this study used proper methods and data, and IF the conclusions are accepted by the scientific community, then I will assume that there is some validity to the study. That said, for the sake of argument, lets say that this study was 50% inaccurate (which is a HUGE margin in the scientific community).. that would provide us with only 4 out of 1000 are falsely accused vs the 2 of 1000 as reported... Still tremendous odds for those who say they were falsely accused...

If this argument of strange behavior, confusion, and basically being "anxiety state, unspecified" is considered evidence and can explain away all of the contradictions and lies, then in reality there would be no defense, and no need for a trial. Any woman could call rape and there would be no defense.

It almost seems like they're telling an entirely different story during closing arguments that was told throughout the rest of the trial

Everything this woman is saying and every witness she is talking about was completely torn apart by the defense. Paolis closing should be good.

Again, Boylan says "this isn't he said, she said" right after she admits that the evidence in this case (such as the clothing, blanket, etc) has little value because we already know that they had sex. Is she really going to convince the jury that this is anything but he said, she said?

The defense's only mistake was in not disqualifying this judge; to deny the defense the chance to make a motion to dismiss at the end of the state's case is outrageous. How can the county attorney abdicate his responsibility to a politically motivated vounteer prosecutor?? Part of the whole checks and balances is that the ELECTED county attorney or his deputies prosecute a case; then its his nuts on the chopping block and is a good motivator to prevent this bizaar scenario we now have, thank you and good day; your friend, yogi
