Okay. Gonna stick my toe in the water because I have a question for UMGriz75: If the jury returned with a Not Guilty verdict . . . COULD the judge set that verdict aside and pronounce him guilty?

Please tell me no, please tell me that I have been watching too much Law and Order: SVU. Because this judge terrifies me.

Because the witness was the defendants dad testifying as a character witness. Not only was it inappropriate, the witness wasn't an expert and his opinion was just conjecture. I wonder how much of the accusers mental state could be caused by her knowing J.J is not guilty of what she has accused him of and that this matter has gone way further then she ever thought it would. hence possible suicidal thoughts or tendency's to keep from having to follow through the legal process being pushed by the prosecutors and the media. Symptoms getting worse over summer and as trial time got closer too.

i agree he will be found not guilty. the prosecution will close with something like this, but it won't be enough.

1. she texted her roommate immediately after the event (this isn't something someone that's lying typically does)
2. she used the word 'think' (not something someone who has premeditated a lie does)
3. she went to sarc and she had a rape test conducted (going through a lot just to accuse someone of rape even though she probably knows she has very little chance of getting a guilty verdict)
4. the investigating detective pointed out that she made statements that someone who was lying wouldn't have made.
5. johnson, by his own admission, pinned her arms down and bruising shows up on photos taken during the rape test.
6. she has other injuries consistent with someone that has been raped.
7. testimonies of those that she talked to and who assisted her during the process.
8. he initiated 3 out of 4 texts sent between the two yet he says he had no serious interest in her.
9. he had been drinking the day of the event.
10. he said in his own words that he rolled her over.

the defense will the get up and say something like.

1. she didn't know if she was raped or not.
2. she gave him a ride home.
3. the photos from the rape test are consistent with consensual sex.
4. johnson has never been in any trouble of any kind and by all accounts was an upstanding young man.
5. he was shocked when he got the letter from u.m. telling him of the allegation.
6. there were two others in the house when the event occured (not something most people who have the guts to do).
7. she sent a text with a smiley face to someone right after the event.

if it this wasn't a reasonable doubt trial, she would probably have a shot at getting a guilty verdict, but there is too much doubt there.

Is there such a thing in the US as a crimianl trial that is not "beyond a reasonable doubt?"

Well you could argue the "Honor Court" at UM offers students just such an option with its new, enlightened standard of proof. :roll:
 
I think Paolis only mistake was calling this last witness regarding PTSD...the recall by prosecution is leaving some real thoughts in jurors minds....they never would have had that shot if not for beign able to call rebuttal...should have closed with Jordy's dad......
 
Bell said she reported friends were uncomfortable talking with her, she with them. #johnsontrial Her social support whittled away.

all the Bell testimony could be related from the stress of the upcoming trial, the mushrooming of the whole incident into national subject matter...just sayin

Zoloft is not a cure. It helps manage symptoms all the while causing some really crappy side effects including in some cases worsening of the symptoms and suicidal ideation. Cognitive behavioral therapy where you truly have to address your demons and do some hard work is the only true cure for some of these psychological issues if she truly does have them.
