Griz player staggered after crash due to concussion, not alc

University of Montana Grizzlies linebacker Brian Maus was staggering around after a rollover accident on Hillview Way because he had a concussion, not because he was drunk, a petition filed in Missoula County District Court claims.

I'm not familiar with the facts and obviously haven't seen the police report, but it's a plausible argument...a lot would depend on whether or not the arresting officer noticed alcohol on his breath or an odor of alcohol...or other evidence, such as containers or cans scattered around the vehicle or the immediate area.

Underage ANY amount is all it takes...... I would think a roll over would be pretty good cause to investigate, but maybe the cops should drive past. Their certainly is no end to the creativity of DUI lawyers.

In any event you right I'm sure the medical records will clear it up. A concussion is pretty easily diagnosed and documented.
 
Wait... he gave a false name and info, staggered, and had amnesia (due to a concussion) but he knows with 100% certainty that he didn't refuse a blood or breath test? :clap: Open and shut case my friends!
 
I agree that looks silly at first glance, but I have heard the cops didn't ask him. I have no idea why they didn't, but they can compel a blood test now and they didn't seek that either. Really strange.
 
Didn't he run into a house or something? Presumably before any concussion occurred? Seems to me pretty good probable cause to believe he was impaired.

He didn't run into a house, the articles previously said he stopped "inches" from one, which... I guess everything can be measured in inches - however as I was told he was probably within 10 feet or so from the house, but not just "a few inches".
 
I don't know anything about this case, except I saw the skid marks on HIllview the next day. They started in the correct lane, in the correc tpart of the lane (not on or across the shoulder or center lane) and then swerved across the oncoming lane and across a driveway dropoff. If I hadn't read in the Missoulian that it was a DUI I would have guessed from the skid marks someone locked up the brakes and swerved to miss a deer (a huge problem on this road).
 
So this is going to be another player that got accused of a pretty serious crime but then will probably get it dropped to reckless or nothing at all. Yet it will be listed for years to come as one of our players breaking the law. :coffee:

He didn't run into the house or even come particularly close. (4 vehicle lengths away) He landed upside down and had a huge gash on his head and a skull fracture. Was he drinking? I don't think anyone knows for sure.
