Do you know what a lawyer uses for birth control? His personality.

A lot of gobbly-gook to say that non-renewal is okay. And if the contract is fulfilled ( salary paid on time benefits kept in tact etc.its not a discharge) Pflus contract allows the President to assign jim any duties as he sees fit. A severenc package is different. FWIW Pflu can't take a new job either until the end of Dec.

You are a total idiot. Not one thing you tried to say in that post is accurate.

Unlike the Yellowstone case there is a limit on the Income that a coach can make, thus the "severance" as you like to call it can have a real number attached to it.

But as with most lawyer speak all the goobly-gook sounds great in press releases and in client meetings and sometimes even means something but most often it leads to an "oh sh**" moment. Thats where the judge finally gets tired of reading all of the crap and says we'll let a jury decide. (thats when us dumbasses get to decide) At that exact moment the attorneys say "oh sh**" and quit chest pounding and pretending to be high school debaters (you know, in the absence of substance we'll dazzle 'em with bullshit) and sit down and work it out. This one is so simple they'll never get to that point.

Question for the lawyers: If you could choose, would you rather represent Pflu or the State? Which has the better case?

Without question Pflu. First, the Yellowstone Club decision makes it clear Pflu's termination is subject to Montana's Wrongful Discharge Act. Second, if you believe O'day and Pflu, Engstrom has already admitted to firing both of them without cause (Engstrom will be held to the reasons he gave them on the day of their termination, he won't later be able to argue he fired them because of the sexual assault issues or player conduct issues). This equates to a wrongful discharge under Montana law. As such, the only question left to be decided is the extent of damages, which sounds like a pretty damn good plaintiff's case to me. While people may disagree over whether the two should have been fired, I think we can all agree that Engstrom and the U have handled the matter horribly.

Only a few people KNOW what was said in the "meeting". What we do know is the University can't and won't say why "the contracts will not be renewed" JOD's comment of them wanting a "change of leadership" indicates more was said. With or without the Yellowstone case, Montana allows a lot of leeway in discharging management. Lack of confidence (or need for a change) being one of them.

I wouldn't spend much time worrying about it. They are gone. They will stay gone.

And I know that this may upset a few BUT the supposed cost of letting them go came from the Missoulian...
It could be a lot less. JOD and Pflu have been equally quiet as the U has. The only word has been their contracts won't be renewed. That would be just as true if they were actually fired WITH cause and maybe they were...
