Chance of Recusal

Kind of strange that we have three former co-workers in the Missoula County Attorney's office on three sides in the JJ proceeding. With Pabst accusing VV of prosecutorial misconduct, I would think that Townsend might be considering recusing herself from this case.

She would have to recuse herself of every case before her. Shes been gone long enough. I have trouble with pabsts involvement more that Karens.

Every case before her does not have a claim of prosecutorial misconduct. Either way she rules on that issue she's potentially setting herself up for an appeal based on bias.

Judge Townsend likely would only consider recusal if the scope of the DOJ investigation included her role as a prosecutor. Highly unlikely. As for Pabst, she has done nothing unethical. Any relevant fact obtained by the prosecutors is not privileged and must be turned over to the defense regardless of who is defending the accused. It's a non-issue.

How do you have trouble with Kirsten's involvement? She left the office before this case came to light. Does this mean she should remove herself from any case involving sexual allegations? She is a very good attorney.

I can't believe JJ has her as an attorney, quite frankly. It's like hiring the coach who has just been penalized by the NCAA to run your team.

In terms of "conflict of interest" compared to Karen because of contact, her experience, is more recent, nothing more.

I don't see the needfor anybody to be recused......

She didn't get penalized, she graduated to the real world. Analogy fail!
