NIL QUESTION

Some of you in-the-know should have an answer to my question, actually two questions.
The Board of Regents has dictated(?) that the maximum amount that both UM and msu can allocated towards the NIL is $1,500,000. How is this number broken down between the football team and the basketball program? Second question, football can give partial scholarships, what about basketball? Another question, can women’s sports like women’s basketball or soccer receive NIL money? I’m sure this has come up before but I’m not in the know.

The $1.5mil is the max amount of revenue UM can share with student athletes. Per Kent, the majority of that money will be spent on football, men’s and women’s basketball as those are the sports that actually generate revenue. Athletes are still allowed to promote their own brand and engage in 3rd party NIL deals. Soccer for instance had an NIL deal in which every player on the team received money.

Out dated thinking in today's NCAA landscape, maybe the BOR needs to be replaced. A lawsuit in the making, you can't cap one earning potential. Yes, with House vs NCAA lawsuit/settlement, football, basketball and soccer have roster limits, the school can give full scholarships to the roaster limit or can give partial scholarships if they don't have the money.

All sports/players can receive NIL, companies can directly give players/programs NIL.

A board of regents can certainly cap the spending of a university. You have some odd views.

BOR needs to be replaced, I can understand capping to avoid over spending, what is the rationale of capping University funding to 1.5 Mi, in todays climate this is like a slow death while your trying to recruit.

Because the universities don’t have any excess funding. I assume the legislature and board of regents can reduce current funding if universities overspend. There is zero chance the board of regents gets replaced. The governor appoints them, subject to legislative approval.

In todays environment you need leadership and have the ability of the legislature and BOR on your side, here is a great example in NC, ADs/Presidents of the largest universities had meetings with the state senators, one of the ways NC schools are getting more money is: they raised the taxes on legalized sports betting and gambling machines (Montana has both) and share a percentage of those revenues. After a year more than 41 million was raised and split between the 13 NC schools. It can be done.

Montana collects a 15% tax on video game machines and made 83.1 million in revenue in 2024
Sports betting tax made 8.4 million in 2023, since 2020 Montana sports betting brought in 276 million.

If you increase these taxes it would bring in millions to UM/MSU

Raising consumption taxes of any kind even on gambling is not something I personally support and likely most Montanans will not support it either.

The State wants those tax revenues for itself and for decreasing income taxes. Also, to take some pressure off rising property taxes. Not for more university spending and certainly not the pie in the sky risk of moving up. You must not live in MT or are new.

What if your means is greater than the cap? Im with MGS on this one. Im sure i dont understand all the legalities and what nots of the situation. Say our collective receives 2m in donations, they're not allowed to give it all to the athletes?
And say they receive $1M the next annum? We can play this game all day, but the cap is the means they need to use. Realistically at the FCS level, should be sufficient and probably near the top of collectives.

Jersey patches on uniforms are coming this season, so your saying if Whitefish Resort wants to sponsor a Jersey patch on all Griz uniforms and wants to give (Tax Deduction) 3 million a year for 5 years, UM can't accept it. Putting the university an a big disadvantage if true, while other schools in the BSC and summit league have no cap.

UM should market that Montana has some of the lowest consumption taxes in the nation which are the taxes that effect most college students.

The Summit isn't a football conference. I doubt other BSC schools spend in excess of $1.5M per year in NIL. UM can accept the money, there is no cap on earning. Keep going, you are doing great.

In your example, they would not allowed to pay out the extra $500k to student athletes. Kent said money raised in excess of the cap can be spent in other ways which improve the student athlete experience. Perhaps lights/locker rooms for softball/soccer, athlete nutrition/strength programs, an on campus tennis venue, etc.

Revenue share and NIL are different. You can give to the NIL and it goes to the players without a hard limit. The revenue share is what is capped, in my understanding.
